Deposit refunds

Hi I recently booked a stay in an apartment in Dublin and paid £200 deposit.
I was unable to make the trip and cancelled the booking on the Monday.
I was due to arrive on the Friday for two nights.

I was then informed that I would not be getting back my deposit as it was outside there 7 day cancellation policy.

I then had a discussion with the manager and explained that i was under the impression it was the standard 48/72 hour cancellation policy and was not made aware of anything different. She then told me it was on their FAQ on their website.

Am I able to get any of this back or is this a total loss - I never received any communication via phone or email to disclose their 7 day cancellation policy??

Please help?

    What is this "the standard 48/72 hour cancellation policy" you speak of?

    Did you book directly with the Dublin apartments?

    They have a duty to mitigate their losses, and only keep unrecoverable losses, so if they fill the room between now and Friday then you would have a good chance of getting your deposit back. Try ringing on the day you had booked to stay and asking if they have any rooms free. If they say no, you have a good chance of getting it back.

    **Edit: This is under UK law. Irish law may differ**
  • The room was never filled.
    Most hotels were i have stayed they had a 48/72 hour cancellation policy.

    My issue is I was never made aware of their 7 day policy and would have cancelled before then if i was aware of it

    How did you book? if it was on the website then you will likely have confirmed that you had read the terms and conditions as part of the booking process
    If it was on the phone you may be able to ask them to listen to the call to see what you were told re cancellation policy

    I am not aware of this "standard policy" you refer to. I book hotels every week and they range from cancel up to 4pm on day of arrival, cancel 2 days before, no cancellation

    Why didn't you cancel as soon as you knew you wouldn't be going?

    Most hotels where I've stayed have no cancellations, so you can't judge by 'most hotels'.
