Parking ticket!

Ladies and gents,
I parked my car in my usual car park today and sadly forgot to pay and display. I have used this car park for a long time now and have never had any trouble before and the attendant knows me by face and regularly has a chat with me (making me think he was a nice enough guy). I arrived back at my car, drove away, got home and realised I had a ticket! I jumped straight back in my car to exchange some thoughts with the attendant but he wasn't there.
So.... I am now faced with a £60 fine or £100 after 14 days.
I have read the newbie stuff and this leads me to believe that I should formally complain to the car park management? Not sure if this is correct so please could the experts give me some advice or let me know if I have a leg to stand on? If I am to complain then what should I say?
So that everyone is aware, the 'parking charge notice' is done under the name of 'UKCPS'. Not sure if I should disclose the name of the management company who has their name printed on the pay and display tickets so I'll keep that hush for now.
Finally, I am aware that in an ideal world I would have paid for a ticket and this wouldn't have happened but we are all human and accidents happen......
I eagerly await your responses.
Kind regards,
An Angry Yorkshireman

they dont have a heart these people m8, especially not UKCPS
so you can try the landowner for a cancellation, always worth a try
but your best bet is wait for NTK and appeal it to ukcps, if necessary getting a popla code and appealing to popla
the grounds in the template letter (and maybe more for popla) are the "legs you stand on"
its not a fine though, its an invoice
so the invoice should be for the cost of parking and chasing you up, maybe £10 , but isnt, hence why you appeal it0 -

Now if you felt happy enough to exchange pleasantries with the attendant while he was doing his job, you can hardly take umbrage when you are on the receiving end of him doing his job. It's like being chatty enough to a store detective but feeling aggrieved if he catches you nicking something.
Forget having words with him. Your fault - take responsibility.
However, putting that aside, the PPC he works for shouldn't be getting the swingeing charge they want, and we can help there.
It might be helpful if, when the NtK comes, you let us know if the Management Company's name is anywhere on the letter though.0 -
You're right that exchanging pleasantries with the attendant isn't the right thing to do Guys Dad and thankfully it didn't happen. And yes, it's completely my fault.
I believe the management companies name is on the tickets from the pay and display machine. Would I be right in thinking that? I could PM you the name if that would be of any help to the situation. If not then I will hold tight for the NTK to arrive and post up the information then.
Thanks for the advice gents, greatly appreciated.0 -
Yes - just wait the NtK, unless hire/company car.
I wouldn't worry about naming any management company myelf unless you have particular reasons. But wait to see what NtK says.0 -
Well my NtK has come through from UKCPS... Basically a load of referencing of the protection of freedoms act, reply in 28 days, your charge is now £100.00 and will increase if you don't pay.
So do I go straight to writing a letter to respond or is it worth sharing a bit more of the detail in their letter?0 -
read post #3 as that asked a question you have not answered even though the NTK has arrived0
-
Can't imagine their NtK is any different to the n number we have seen previously, so no need to upload it here.
One thing to check first is that the NtK was received in time - ie between days 29 and 56 after the date of the parking event (weekends/Bank Holidays included). If not, that becomes more significant.
You then need to make your initial appeal to UKCPS using the template in post #1 of the NEWBIES sticky. The likelihood of this achieving a cancellation is slim; the main purpose is to draw a POPLA code from them, where you will be able to stamp on this charge (provided you continue to follow forum advice).
The initial appeal has been carefully crafted so as not to reveal who the driver might or might not have been. It is worded in the name of the Registered Keeper: it is important you neither tamper with the wording nor add any 'I, me or myself' which might implicate you as the driver.
After you've sent that off it's time for you to start to look at how to 'craft' (largely copy and paste) a winning POPLA appeal by reading post #3 of the sticky. UKCPS have 35 days to respond with their decision, so a bit of time to prepare in bite sized chunks.
HTHPlease note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thanks Umkomaas. They sent it within that time period.
RedX, the only company name on the NtK is 'UKCPS'. I can PM or post the name of the company on the pay and display tickets but I'm not certain that is the management company or if this will be of any significance?0 -
as post #3 said, the name of the creditor should be on the NTK, its not, so more ammunition ( so a simple yes or no to the question would have sufficed)
so now use the template letter "as is" no reducing it or adding wording that may make admissions etc
this now has nothing to do with "what happened" and everything to do with legal challenges , its all about cancellation or a popla code0 -
Okay RedX, I'll try keep responses concise in future. What are the implications of the management company / creditor not being on the NtK?
Thanks for the advice once again gents, greatly appreciated.0
