Help With Moorcroft debt recovery

hi guys hopefully this is posted correctly, I really need your input

A few months ago I applied for credit and was unexpectedly refused,

I requested a copy of my credit file and Moorcroft had two separate listed entries (in default) for student loans totalling just under £500. and had been on there for almost two years (wow)

My middle and last name was used which was unusual as all my other financial agreements used my first and last name naturally. And it was at an address I have never lived at!

I contacted Moorcroft,

a.this is not my debt
b. that's not my address
c. Im not a student
d. provided them with a police crime number
e. and the unusual use of middle and surname


they quickly replied asking to confirm if I banked with Natwest (no I Don't) they asked me to confirm a company I worked at, (I do not work at that company) they explained that it was not student loans rather payday loans either way the debt is clearly not mine.

I replied giving them 28 days to remove this entry now 6 weeks on I had to contact them this morning "we still believe this debt is yours Mr Wilson so we have not removed the entry"

Ok so what now guys? I'm so furious at this! can I take them to court? what should I claim for damaged credit file? will a court order the removal of this entry! I cant believe a company can just maintain a debt is yours like this!!!!!! any input or advise appreciated.

they've been provided with crime reference numbers are they somehow above the law..... grrrrrrrr

    I would write to them again heading up your letter as a formal complaint. Include in the letter that if the issue is not resolved and the entries are not removed from your credit file that you will be making a complaint to the FOS and the ICO.
    If they still don't resolve it then make the complaints to those 2.

    You could in the meantime also dispute the entries with the credit reference agency they appear at. They should also then contact the debt collector on the matter.

    Thanks for the response I should have mentioned in my original post I did go through Equifax to raise a dispute on the entries and surprise surprise Moorcroft still refused to move them! so you can see why I'm getting so frustrated with this.

    I guess its time for a final complaint and see what happens.

    I would class the issue you raised a few months ago as a complaint and therefore call the FOS as 8 weeks has passed with no final response.
