will i get ESA as a student?

hello

i have read many thread and many people are so educated. i have a question on ESA.

last year i opened my own business. i do not have the NI contributions for ESA.

i am hoping to start a university course this september, will i be able to claim ESA as a disabled student on a university course?

i have three children under 12 years old. My husband earns just under £21k a year.

    You can only get ESA as a student if you get DLA or PIP. I'm not so clued up on the couples rules, as I'm single, but I'm pretty sure that your partner earns too much for you to claim as you wouldn't be eligible for conts based.

    My DD'S claim was started when she went to college but it was a specialist one. There are rules around the types of course you can do and get ESA.

    If the course is part time, the rules regarding DLA / PIP don't apply.

    I have a feeling Chrissy is on about something different. Unfortunately, I can't remember the regulation regarding that one.

    I cant remember exactly what it said but it was something to do with "non advanced" courses.
    The college dd went to [very briefly] was aimed at helping young people become as independent as possible or at least that was the theory !

    Non-advanced education is 6th form / college / a levels / further education. The OP is in higher education.

    Can I claim employment and support allowance as a full time advanced higher education student?


    If you are a student you can claim contributory ESA if you have paid enough national insurance (NI) contributions. You will have to satisfy the limited capability for work test.

    As a full time advanced student, you can only get income-related ESA if you are also getting disability living allowance (DLA) or Personal Independence Payment (PIP). As a higher education student you will be automatically counted as having limited capability for work. You will still be assessed under the limited capability for work-related activity test, which decides whether you are in the support group or the work-related activity group.

    Job centre plus has told me as my husband earns 21k and works 35-40hours a week I can not get ESA.
    Hope this information helps someone else too.
