Esa in Scotland

Ok, so your claim for ESA should be still open for National Insurance Credits
A year ago when your ESA stopped you could have done an ESA3 form and would probably have continued to get £100 a week.
You can do an ESA3 now and ask that it be backdated to August last year about £5,000.
You may find that DWP only backdate it 3 months. In which case, you should appeal to get it backdated the full year - and come here ask for more help to win your appeal. Certain people on this board may be able to help with more info on this subject but apparently people have won tribunals for ESA IR arrears beyond 3 months because there is already a claim open for ESA, and there is no distinction betweeen conts and IR so you can apply for IR at any time and have it backdated to the start of your esa claim.
It would help you...... if anyone reading this can provide tribunal rulings and upper tribunal rulings references or links on this subject.
If you are sure your ESA is still open you needn't call or write any letters, just get an ESA3 from your local Jobcentre and send it to the ESA BC, then phone ESA after 10 days to check it did arrive.
If you are not sure your claim is still open you should call ESA. Your claim should still be open unless you asked them to close the claim.0
