Sales of goods act

Morning all,

I have a wine cooler from howdens. I took delivery 2 months ago as they offered me a discount but it was only installed this week.

The chiller is faulty as the fan is constantly on, I called them to say I want a replacement and they said they need to repair it, am I entitled to a replacement? Or do I have to accept a repair.

    Howdens are a trade only outlet, was this a B2B contract? If so you're rights under SOGA are limited. Even as a consumer you only havea "reasonable period" within which you can accept or in this case reject an item that doesn't conform to contract, after such a period, they would be entitled to provide a repair as a remedy.

    I have been into my local branch on a number of occasions to make purchases of kitchen units and they have never enquired about my trade status nor did they inform me that they do not deal with consumers.
    In fact, the first time I went there and asked if I could buy something, I was clearly told that providing it was going to be a cash payment, they would be happy to sell to anyone.

    That must be on a branch by branch basis, when we were looking to refit our kitchen last year they wouldn't even let us look at the show area unless a tradesman either came with us or made an appointment for us. They wouldn't sell us anything, it all had to go on a trade account
