Direct payments contract - don't want to sign it

I had a review of my direct payments and my new contract is not funding things in my original support plan.
I have not signed it and am getting a review next week, but adult social care are trying to get me to sign it and said the money won't be backdated, my contract is from beginning of June, but the point of the direct payments is that you save up money to purchase things in my case I need respite so I am reluctant to sign as they are not funding my full respite needs as well as some other things.
I am out of money to pay my PA and HMRC at the end of my pay period.
Does anyone know what to do or Where I stand legally

    My understanding is that they're correct.
    If you don't sign the new contract, your money stops.
    It does not continue at the old rate.
  • Yes the money does stop if you don't sign.

    What I am asking is the council are not funding my care needs in my support plan. Therefore I do not wish to sign the contract, where do I go from here?

    You are under no obligation to sign the contract if you don't want the money.
    If you want the new support plan to be more generous, you're likely to have to follow the appeals procedure. Signing it will generally not mean that you accept it as the right decision.

    This is not likely to be a quick process.
    There is unfortunately no good answer to this.

    the fact that the funding offered doesnt match your care plan is a bit of a red herring.
    many people have care plans and receive NO funding at all.
    the direct payments contract is reviewed yearlt andattempts to go 'aome way' to addressing your needs and wishes.
    they arent obliged to fund you to the extent you ask for

    I don't know how to appeal or what the appeals process is.
    It alls seems abit onesided they send you a budget figure, they didn't send me a breakdown with that figure of what they had funded, then I discover they didn't fund my full respite costs which I need.

    I was unaware that signing it did not meant I agreed so thank you for that information.
    I am discovering it is not a quick process and I appreciate you pointing out there is no good answer.

    I am aware that some care plans are not funded but due to my care needs I hope to get some funding otherwise I will need residential care. Whilst I am aware they don't have to fund all my wishes I would like/need my respite funded due to family issues.
