wow shocking, im sorry i dont have an answer, my employer would never do that at all. do they not have to 'honour your holidays' ?
  • I don't think any employer would do that but then again why would they if people don't know their rights?

    That's why I'm asking...

If they approved my holiday, I booked my trip, paid for it but I can't go cause employer cancelled my holiday... what then? I mean I was saving for that trip for a loong time and I don't mind going any other time but I can't afford to pay all of it again...

    Somebody plz help...

PS. I just realized that by "my employer would never do that" you meant cancel your holidays not to pay you back :D

What local agreements exist to deal with such situations?

If the leave was officially authorised I'd expect the employer to ensure you were fully reimbursed all out of pocket expenses and then some. Was the leave agreed and authorised before arrangements were made?

Is this Q. hypothetical or has the situation arisen?

well they can cancel it if they give appropriate notice (twice the holiday length i think)

BUT, if the refused to pay for the lost costs, then you'd have a company wide issue for the workforce as no one would want to have their holiday cancelled and lose all that money. So its very unlikely any company would do this in practice (bar say the army who may have to in certain circs, i imagine)
  • My holiday was booked and approved before I paid for anything. But I was told that they might have to cancel it.

As I said I know that they are allowed to do so and I don't mind going later but I need to know if I'm gonna get my money back or no? There must be some regulations or something, I can't be the only person in this situation ever...
  • A good employer would reimburse you but ultimately if the cancel your holiday giving the correct notice required then the only way I believe you could claim the money back is through the small claims court to force them.

Generally if they say might I would expect them not to cancel it but you need to try and get a final decision asap and explain you will be booking a trip away and if it is cancelled you will need to be reimbursed

I also don't believe you could claim it back via small claims.

The employer can't FORCE you to cancel your holiday, you'd be doing that as your employer requires you to work. So you could say no to your employer and see what happened.

Maybe some insurance companies cover you for this. But i doubt it.

(I thought I'd have to cancel my last holiday as something crucial came up at work - but it would have been reimbursed for me and my OH - as it was I took laptop away and they can pay for my phone calls and data usage)

If the possibility has come up......provide them with your flight and hotel etc invoices with a note detailing cancellation charges and odds are they will either forget the whole idea or offer to cover your costs depending on how badly they really do need you.
Far better to preempt the idea rather than wait til they cancel it.

Employers can force you to cancel your holiday if they give the correct notice.
