                    Hi,
I've been a regular visitor this site since receiving my original PE letter back on 22/04/2014. I ignored first letter asking to pay £60 charge. I then received a second "reminder" letter from then at which stated i used the sticky threads on this forum to put together a claim directly with PE. Obviously they responded rejecting my claim.
The car park is a "free to stay" retail park located in plymouth; devon. I parked in there with my girlfriend which she attended a medical appointment in town. Upon entering i saw no signs showing a "max stay 3hours" so we walked into town (appointment was delayed) and ended up taking 4hours 47minutes...we literally went there and back, no where else. A few weeks later i then started to receive correspondence from PE.
I cited my defence when i received my court claim notice outlining and maintaining the signage cleary was not visible upon entering the car park (when i returned too check the sign is on the entrance just off a busy main road about 8-10ft in the air...in other words no way too stop and read without causing a massive tailback!!!) where i parked in the car park there was no signs advising of a max stay period...PE have confirmed this by sending photo of the retail unit outlining where the signage had been put up. I can upload the photo and outline where i parked if somebody would like too see?
On the other side of the carpark there is a sign every 10ft on every lampost but on the side where i parked (the older / run down side) there was 1 sign which covered around 200 spaces from a quick count! the sign of which is no where near where i parked!
In the court back it states no court date only that they wish too pursue... do i count my losses and pay up or do i stand a chance in winning?
THANK YOU FOR READING!

You need to get a copy of the Parking Pranksters Guide to Fighting a PE Court Claim. Jam packed with everything you need, and only £3.60. The Parking Prankster website will be the best place to get it. It also has the documents that you can use and read up on.

 yes
 1) read the NEWBIES sticky thread, post #5
 2) use the forum search to find the dozens of other similar court claim issues (by MCOL) and read the advice therein on them, even if its CEL or UKCPS or EXCEL or one of the others (but they will predominantly be PE and CEL)
ie:- its not as if you are the first one to ask or post about an MCOL on here , especially from PE, which is why prankster wrote his books about it0

 - ignored a PCN from the most litigious PPC which has issued over 13,000 court papers in a year?
 - appealed late (it's not a ''claim'', not on your part, it was an appeal...)
 - ignored your chance to appeal to POPLA when you got a POPLA code with their rejection letter? Or did you appeal far too late for that?
Please read post #5 of the NEWBIES thread - it tells you how to defend, what happens when and links examples of winning cases. What a wasted chance to just kill this at POPLA stage like everyone else has done for months when they've found this forum. If you'd simply appealed and then sent one of our template POPLA appeals in time it would have been cancelled. Now you have to research how to win in court - people have a chance IF they research it well.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
