Claims Management Company Contract

Hi All

I have looked at some of the similar answers around here and I have not quite sure I have seen this problem, so advice would be appreciated, here goes....

I stupidly went to a claims management company to make a PPI claim for me, as it happened I had already opened a claim that had been denied as the company (Lloyds), they said there was no PPI on a credit card. The CMC initially said they would take up the claim, then they received the same response as I did that said there was no PPI on the card and they verbally dropped the claim sending back a DSAR (I have the letter about this) saying they would not look into claims that had already been refused.

I then appealed to Lloyds and after about 9 months they eventually agreed to pay up.

At the same time I was appealing to Lloyds I received a formal letter from the CMC saying they said they "must close my claim".

I think the letter says the CMC can no longer claim their cut of the compensation. According to their terms and conditions this seems to me to be a severance of their contract to claim PPI on my behalf.

Does anyone have experience of something similar or an opinion to offer on whether the CMC will suddenly claim their cut?

    Most CMC contracts have a contractual clause that allows them not to pursue a claim for whatever reason, thus terminating the contract and it sounds like they've exercised it.


    Which CMC is it?
  • It's a company called Owl Claims, to be honest I think I have answered my own question as in their T&C's they state specifically "6.2 We can cancel this arrangement at any time and no fee will be payable by you, if we advise that your claim is unlikely to succeed and if you have not breached your duties set out above." So given the letter I have, they would not appear to have a leg to stand on.
