Hi all..
Where I'm at:
- looking at applying for mortgage possibly in 6 mnths time or so.
Problem:
- arrangement to pay marker on account from Lloyds (Oct 08-Jan 10).
Lloyds refused to remove this marker stating that the agreement was correct and affordable for me at the time. The details are hazy to me, but in their final reply letter, it mentions something about 'you made a bulk payment of £135 in late Jan 10 to clear the arrears, proving it was affordable at the time'.
Subsequently, I have also just found a letter on my computer dated Feb 09 requesting that Lloyds return charges to my account of £138, which seems very coincidental.
Is it worth pursuing this to try and get the marker removed/changed to a default or will it not really matter for mortgage?

I thought it could be coincidental due to the fact that I applied for £138 back in charges, then made a payment of £135 which then cleared my balance? i.e demonstrating that no, the payment plan was NOT affordable as they say, I could only pay back the charges because I got a refund.

Not sure why you would want to change the arrangement to pay to a default unless you want it backdated?0

Yes, sorry maybe wasn't clear enough - I would like it backdated to 2008.

Definitely pursue it then, Sent them a letter and if they refuse to contact the information commissioner as there guidelines state a default should be applied 6 months after falling into arrears, you may not get it to 2008 but 6 months after you entered the arrangement, Im doing similar with mine and halifax have already agreed0 -

The date of default recorded was march 2013, however this has treated me unfairly as ICO guidelines on filing defaults state that normally a default should be applied within 6 months of getting behind with repayments which I believe should have been December 2011 and i have been penalised for making payments putting my credit file in a worse state than someone who did not0 -

I have contacted Lloyds who are refusing to do this. May send this to Financial Ombudsman though, thanks.

Thank you - yes they have refused in writing.
Within their letter they state next step is Financial Ombudsman?
I may also write to Lloyds Credit Reference Team once more with your template.

ah right ok, I would do both then as the ICO is about how your data is handled0
