my mother in law bought a washing machine and oven Brighthouse and up until last week she had an agreement with them to pay instore fortnightly, two weeks ago she rang up and set up a fortnightly direct debit payment with them over the phone, she has now been to the bank and found out they have been taking the payment weekly and have caused her account to go overdrawn causing an automatic overdraft charge. Bright house have said they will return the early payments but will not pay the overdraft charge? where does she stand on this? is there anything i can do? please can someone help.

What does the contract say with regards to payment amount and frequency?
If the contract states its £20 every 2 weeks and they've been taking £20 every week, they are responsible for the bank charges as they are in breach of contract and that breach has directly caused your mothers losses.
Write them a letter before action, remember to include a copy of your mothers statement/letters showing the bank charges and that they were due to their breach of contract.You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
her original contract was to pay instore every two weeks cash. Two weeks ago over the phone she set up a direct debit for payments to come out every two weeks until now she has only realised they have been collecting every week, this was done over the phone so obviouslly there was no paperwork supplied?0

Has she tried contacting her bank to reverse the charges? I know at least one bank reverses the charges if the direct debit is reversed but not sure if all of them do it/have to do it.
May be worth looking into.
As for the rest, providing the contract is for fortnightly payments of £x amount and they have been taking that same amount weekly, they are in breach of contract and what I said above applies.
Basically where one party is in breach of contract, they are responsible for the other parties reasonable losses that are a direct result of the breach. They'd be silly to fight it imo.You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
As above, ring the bank and report the unauthorised direct debit payments, they should reverse them and usually charges with it0
