He did claim IB in the 1990's but the DSS said that he wasn't eligible to claim because in 1yr which I think was 1998 they told us he didn't have enough NI Credits, we appealed it with help via the CAB who came with us to a tribunal , which he won but I have a feeling he chose to move onto Income Support with having children at home still ... I still think there's something quite not right about his claim...
Incidentally today we have received another letter telling him to send in another sick note... And is it worth reapplying for DLA? He is kn lower rate care and he his condtion has certainly worsened than it was 6 moths ago,
He has diabetes type 2 insulin controlled, kidney problems, hypertension, tumour on his cocys which is thought to be benign but has to keep having MRI scans every 3 months, depression, and now has began to have a monthly eye injection that fingers x will stave off blindness in his left eye for a few years... ( if they don't work he will be blind within 2 years) what does that mean .. Maybe the IN claim has been open since 2007? You will have to help me as not too good with this x and also he has not as yet received a questionnaire to fill in.. Will they send him one?? As I said previously last year maybe sept time he was sent something similar to an ib50 to fill in which was sent back, we filled it in and sent it back to them and never received anymore news on it...0 -
Next time he phones DWP ask them to look in CIS to see if he has or had an open claim to IB even if it was £0.00 and when did it finish. Ask them to click the "view full history" button in CIS.
If he applied for IB and was told had not paid enough NI credits... then the IB would have remained open for NI credits unless he specifically asked them to close the IB claim. Just the same as his ESA claim now..he is not entitled to ESA C but the ESA claim is remaining open for NI credits.
If he has worsened, then inform PIP or DLA that it has worsened and he wants to be reassessed.0
