    Ah, so does the PPC submit their own 'evidence' to POPLA and then I have to challenge that?
    Or should the rebuttal of their evidence be in my initial appeal to POPLA?

    I have yet to receive the PPC's 'evidence' pack. Do they always send them? I assume POPLA would update me on reciept of this via email? My POPLA date is in roughly 2 weeks.
  • It is not unknown for parking companies’ evidence packs to go “missing” and so it would do no harm to send an e-mail to appeals@popla.org.uk, something along the lines of:

    Dear POPLA Administrative Team,

    POPLA Code 123456789, Excel Parking

    Further to your notification that Excel would send me its evidence prior to consideration of my POPLA appeal scheduled to take place on or soon after [date], I write to advise you that I have not yet received Excel's evidence pack.

    It is possible that Excel may have already sent you its evidence and it may simply have been an oversight that it did not also provide me with this. If this is so, given the close proximity of the scheduled appeal review date, I should be very grateful if you would forward a copy of Excel’s evidence submission to me as a matter of urgency in order that I may review and respond to this.

    Alternatively, if Excel has not provided you with its evidence, please let me know by return. Although I would be very disappointed to learn that Excel had failed to engage in the arbitration process, if this is indeed the case may I assume that my appeal to POPLA will be upheld?

    So POPLA responded a bit after the email above saying they hadn't received anything.

    And today I got an 'important' e-mail from POPLA.

    "The Operator has informed us that they have cancelled parking charge notice number xxxxx, issued in respect of a vehicle with the registration mark XXXXXXX.
    Your appeal has therefore been allowed by order of the Lead Adjudicator.
    You are not liable for the parking charge and, where appropriate, any amounts already paid in respect of this parking charge notice will be refunded by the Operator."

    Success! Didn't even make it to the appeal 'hearing'. Thanks very much to all who helped read over my appeal and point me in the right direction when I got lost.
