Wife was embarrassed, now its too late?

My wife was too embarrassed to own up to this ticket so has done nothing, now its DRP sending us letters :(
Experts, could you please advise me on the following..

My wife was parked at Matalan and was issued a ticket from Smart Parking on the 26/04/14.

She had a Notice to Owner letter on 06/06/14.

DRP letter claiming £130 on 10/07/14.

Is it too late to do anything?

Thank you
John

Yes it's too late, but don't worry about it, Not-Very-Smart Parking doesn't do court.

Smart Parking are one of the easiest PPCs to beat (in the whooooole world) if using a forum appeal. But as you say it's now (possibly - see * below) too late.

You need to read the NEWBIES sticky at the top of the forum index, one page back from here (use Forum Jump button at bottom of this page to navigate there). The sticky section most appropriate to your (or more pointedly, your wife's) situation is that contained in post #4 of the sticky.

    * You could try an appeal to Smart, based on the sticky initial appeal template and see where that takes you; they may be dopey enough to treat it as one falling within their self-declared deadline. While they have imposed this deadline, there is nothing within the BPA CoP or PoFA that precludes them dealing with an appeal at any time and issuing a POPLA code in the event of rejection.

PS - are you the same poster as here on PePiPoo?

If so some of the details don't match.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
