tell him theres absolutely no point in you doing anything until his tree is removed.

Yes but he has to know that there is an issue before he can be found negligent, the neighbours telling him would be sufficient.

Unless you want to rebuild the wall don't bother. You don't have to. You can just put up a cheap bit of fencing if you wish or nothing at all

Ascertain in by looking at both deeds to find our who owns the wall, and possibly the wall fell down because simple walls are not built to keep soil etc. in The retaining wall have to be either / and stepped and / or reinforced. They are not a simple job to construct as they have to have holes for the water in the upper land to drain-away, and they may have to go down some way.

Which is fine, apart from the fact that I have now had 2 different builders round to give me a rebuild

Reading the OP it sounds as though it was never a retaining wall but the neighbour has increased his garden level by infilling against the wall.
