renting my flat

Hi All,

I have rented my flat out using a estate agent .

I used to be on managed and soon realised it was all rip off so now have the let only service which means they will only find a tenant and I deal withe rest.

they found a tenant for me and next month will be there 4 month of living in the flat so I will need to know whether they want to renew their contract before the expiry of it on month 6.

can I just re use the templete from the agent ?
what do you guys in my situation normally do ?

Anything I should be aware of which if not done could cause issues.
such as do i have to ensure both I and her sign the contact and have a hard copy rather than email ?


I could of course go through the agent again but will be wasting £40 for what i can do with typing and simply printing.

your help is much appreciated.

    Are you on a contract with the agents that allows them to charge for renewals while the tenant that they introduced remains in the property ?

    no it was one off fee I paid and all finished now.

    I can still use them though for a fee which they will charge to simply print the same document get both of us to sign which I can do myself.

    I didn't sign any contract with them and certainly don't think they would put any condition in the tenancy agreement which is non relevant and related to me and the tenant and not me and them so short answer no

    You don't NEED to do anything... At the end of the fixed term, the tenancy will automatically become a statutory periodic tenancy, meaning it runs month to month. You have to give 2 months notice that you intend to seek posession, and the tenant has to give 1 month to leave.

    So, it depends whether you or the tenant are really that bothered about having another fixed term.

    By the way, you really should know all this if you are a landlord. I'd suggest reading some of G_M's material in here to ensure you are familiar with the law and your obligations.

    Thanks I knew about the automatic renewal and the notice but want to always do fixed term to cover myself or peice of convinience knowing it is rented for another 6 month .

    so If I wanted to go down the route of fixed term, can I just re use their template ?

    There is nothing on there saying it is copyright protected etc

    Contact the tenants and talk to them! They are people - treat them as such.

    Go and have a chat, or use the phone if you must, and ask about their plans.

    Do they want to stay/commit for 6 months? 12 months? 2 years?
    Are they planning to buy a home shortly and hence prefer the flexibility of a periodic tenancy?

    A good friendly approach is the key to happy LL/tenant relations, but remember it's a two way street and just because you prefer a fixed term does not mean they do. In that case, there's no point creating friction by demanding a fixed term or else!

    Once you've agreed on a term (if that's what is agreed) you'll need a tenancy agreement. Your Landlord's Association (see link below) is the best source but there are many others. Or draft your own using the original as a rough template (if you know what you're doing).

    I think you misunderstood me .

    I am not saying either fixed or out rather prefer it that way and yes I would treat them how I like to be treated . end of the day it is business and they pay me rent so having common sense always there.

    it was just to see what should I do if they agreed to it and what template can I use.
