Is marks & spencer going against their returns policy?

    I think you stand a chance of a result if M&S have admitted that they did not display appropriate 'no refund' policy signs.

    I've bought lots of stuff from my local M&S end-of-sales, these are usually marked on the labels with an 'S' and the rail is always clearly marked 'no exchange, no refund. Does not affect your statutory rights'.
    The SA has always told me 'no exchange, no refund' and I always reply 'I know. Unless I find the item is faulty when I get it home'.

  • They are usually very good at informing people that they cannot return final markdown sale items. There was a member of staff actually standing by the clothing rail in my local Marks last week, reminding the people browsing that the items could not be returned if they changed their mind/did not fit. And they reiterate it again when you pay.

    As long as it is made clear at the time of purchase then they do not have to refund - if a shop does not normally refund for "change of mind" then they wouldn't need to state anything because basic consumer rights would automatically apply it's just that M&S usually go beyond that.
