Scottish law is very different to English; I would suggest looking at the Scottish section of the Shelter web-site.

Maybe. But the two main things to consider here are.....

    A) Will there be much equity in the property from the last 3 years? Unless it's in one of a few certain areas, I doubt it.

    B) Unless A is willing to negotiate outside of court (and I'm guessing they're not), can Partner B afford the expensive legal fees to take A to court? If not, then it's pretty much a non starter.

3 years isn't very long in mortgage world, and A has had a roof over their head during this time. Also, even if they did go to court, they aren't guaranteed to be awarded anything.

If I were in their shoes I would just walk away with their dignity intact, rather than risk a long and expensive fight for the possibility of not a lot of cash.

Can you clarify: by all bills do you include the mortage or just coucil tax, utilities, etc?

Edit: sorry don't know about Scottish law
