Can I cancel flight based on false advertising?

I'd like to cancel my Norwegian Air flight on their new route between Gatwick and LAX. I bought the flight because it was low cost (£450) and because they are using the Dreamliner.

It turns out that due to logistical issues they often do not use the Dreamliner, instead leasing from Euro Atlantic, a private company that, according to reviews, supplies shoddy planes and shoddy staff.

Norwegian do say that at times they have to use a different plane. But from what I can tell on the reviews, this has been happening frequently and I am now feeling really uncomfortable about flying with them.

Since their website clearly advertises 'the Dreamliner experience', I'm wondering if there are any grounds for getting a refund based on mis-selling of the product.

I have no doubt that Norwegian will refuse so I wonder what authority I can appeal to.

    Google dreamliner faults and you may feel a bit better about not flying on one.

  • Provided that you were made aware of the fact that they can and do use different aircraft before you completed the booking, then no false advertising has taken place.
    To be honest, I can't name a single airline who will guarantee which model of aircraft will be used for a particular flight as there are many factors that can cause this to change at short notice.

    Potentially if you could show that they had suggested that the Dreamliner was part of the contract, and not just the flight itself. If you received an e-mail saying "book now for a Dreamliner experience" then IMO you'd be in a stronger position in a small claims court. I'd also say that in that situation they should try and accommodate you in a Dreamliner, maybe on a different date, if that was an integral part of the contract or advertising.

    The big caveat to this are that airlines do reserve the right to change planes for operational reasons and that isn't IMO unreasonable. If you were going to pursue it, and there's no guarantee of a positive result, I'd be contacting Norwegian now explaining that the booking was made because of the Dreamliner aircraft and asking them if they can provide assistance regarding this.
