    We've discussed this before ;)

While you cannot state action can only be brought in luxembourg (ie they have to allow consumers to bring action in their home countries courts) it does not have to be held under the home countries laws.

Choice of law and jurisdiction are not the same.

    Pretty much what Amazon say
    14. APPLICABLE LAW

These conditions are governed by and construed in accordance with the laws of the Grand Duchy of Luxembourg, and the application of the United Nations Convention of Contracts for the International Sale of Goods is expressly excluded. We both agree to submit to the non-exclusive jurisdiction of the courts of the district of Luxembourg City, which means that you may bring a claim to enforce your consumer protection rights in connection with these Conditions of Use in Luxembourg or in the EU country in which you live.
  • I've always found Amazon brilliant for customer service and returns, and they generally go way beyond any standard UK consumer regs.

Ok I see what you are saying.

At least in the UK what I said was correct!

Perhaps contact them and ask before buying where you will need to contact/send the item if you wish to return it?

Well long story short. Ordered item from UK it arrived. Another parcel same day arrived addressed to me so signed for it. Nothing out of the ordinary as we had ordered loads.

2nd parcel was from Amazon France, for a French customer. Sent from the UK. Uk amazon wouldn't deal with it as it was an Amazon FR sale and they wanted it returning to France. Bonkers.

So I am guessing not. I got to keep the item in question too and it was worth a lot of money as they wouldn't pay for tracked delivery, so they told me to keep it :rotfl:I donated it anyway.
