Overseas driver

Hi quick question that I cant seem to find answer to in the forums. We as a company own a car which is used by foreign students when they stay with us for courses. One of the students has incurred parking invoice from private company for parking in pub car park. Are we as the registered owners liable, or can I pass on the address of the driver who lives in Italy.

    Which PPC is it please?

    Was it a windscreen ticket?

    Have you received a Notice to Keeper in the post?

  • Pass the Italian driver's name and address (in Italy) to the PPC, and state firmly with your correspondence that "as you have provided a name and address of the driver, under the Protection of Freedoms Act you have no further liability for this notice, and they MUST cease all further correspondence with you."


    The trouble is, PPCs know that they are on to a loser with an overseas driver, so will claim that the driver's address must be in Engalnd or Wales, else liability will still rest on the keeper. This is a lie, which even the BPA seem to condone. It's rubbish of course - read Schedule 4 of POFA, it says nothing about the whereabouts of the driver's address.

    It is indeed, and if they try it on, report them to your local Council Trading Standards Department, (avoid CAB who will probably advise you to pay up), for attempting to obtain monies by misrepresentation, copying the letter to the PPC.
    You never know how far you can go until you go too far.

    Which PPC? Most would be easy to beat by you as keeper at POPLA stage, so with most PPCs I would appeal it yourself seeing as you've found this forum. If you lost at POPLA or IAS stage, you could still THEN name the driver (name and address). It's not too late to name the driver before any court action so that could be your last resort option.

    This is covered by the Newbies thread in fact - top of the forum. Personally, I would not drop a young foreign student in it who might actually pay the scammers if they wrote to him/her. For example, ParkingEye write to people in Germany sometimes. I would appeal and win, not worry the student about his/her trip to England. Not unless you actually lose at the second stage appeal despite our help.

    Thanks for all your replies.

    I did fire off a letter to the parking company who are Civil Encorcement Ltd of Liverpool. They have given me a rejection reply with a POPLA code, so I guess my next step is to send in the POPLA appeal.

    I don't know if it was a windscreen ticket because the student didn't pass this on to me. I suspect not because I think it is camera controlled.

    We are based in Essex and received Parking Charge Notice.

    Simple case of saying

    "I am the registered keeper. We as a company own the vehicle XXX XXXX which is used by foreign students when they stay with us for courses.

    In this case, the student in question was xxxxxxxx and their home address is xxxxxxxxxxx.

    By giving you the details of the driver and an address for service where he lives, I have discharged my obligations under POFA 2012 and will, therefore, expect you to follow the same act and pursue hime for the outstanding charge."
