Notice of Enforcement help needed

Hi all

I have yesterday out of the blue received a notice of enforcement from high court enforcement group limited claiming I owed E. On Energy Solutions £3836.77, it turns out it is for someone else with the same name as me and would you believe the same date of birth. Now nothing has been resolved as yet as they have to "investigate further" but have assured me that when they have completed I will not have any marks against my credit history or my house.

My worry is that as the notice of enforcement has been sent to my address even though it has nothing to do with me it is going to registered as a black mark. is this the case and what should i do?

All help greatly appreciated :)

Credit is against an individual not an address or you'd be stuffed if the house had previous occupants. Check your £2 reports with Experian and Equifax and your free one with noddle. Likely the debts are on your credit file if it's been traced to your address.
  • I thought it was by association too, like if i wanted a credit card for example and they saw a CCJ at the address then you're knackered?

It's likely debts will be on you file relating to the other person, check it, if they aren't on your files then don't worry it's all resolved.

You need to get hold of all 3 of your credit files and check them. If there is incorrect data on there then you will need to complain to them and they will probably tell you will need to complain to the creditor as well. You are likely to have a fight on your hands to get it removed.
You may want to sign up to the credit monitoring that the credit reference agencies. Normally they are not worth paying for but when you get your files clear you will want to know if this debt pops up again.
You can also apply to CIFAS to get a password so if this is id fraud then the next time someone applies for credit in your name then they will be asked for your password. This should hopefully prevent somone else's credit appearing on your file. It does however mean it will be harder for you to get credit as and will mean that you will have to be manually checked each time, so it will not be as simple.

IF a CCJ has been granted against you then you then I don't know whether you'd have to apply to the courts to get it removed as it shouldn't be against you? I don't know if anyone would know more on this? I believe you can check with the trust online whether you have a ccj against you.
