Credit Report shows debt in my name & address which isn't mine! - IDENTITY FRAUD

I paid for a one off credit report for £2.00 and it showed me 2 finance debts which are in my name but are definitely not mine!

One is Next Directories and the other is Virgin Mobile. Luckily the Next Directories finance looks like it was paid off. But the Virgin Mobile finance was set up in 2009 and still has about £435 left to pay.

The company I used for the Credit Report contacted both companies for me and both replies basically said that both companies (next & virgin) want me to contact then directly.

Now the Next finance shouldn't be a problem because who evers finance it is paid it off. But who ever took the Virgin Mobile finance out has never paid them and Virgin claim there is no evidence that it was fraud and they still believe I am the one who took that finance out as it has always been in my name and address. And they won't remove this off my credit report until the debt is paid off.

So what do I do??

Neither of those 2 finance debts are mine and I am really annoyed about the Virgin finance because they still believe it really is my debt :(
It's not my finance/debt but it is in my name & address and they want ME to pay it before they remove it off my credit report..

    Hi Jake,
    If it was your Experian report that you received [EMAIL="Uksocialsupport@experian.com"]email[/EMAIL] your details to and we can get our Victims of Fraud team to take a closer look at it for you.
    It would also be worth applying for your report with all three of the credit reference agencies (Experian, Equifax and Call Credit) in case there is additional account information you don’t recognise recorded.

  • Thanks for getting back to me and the advice.

    It was Equifax that I had the report from.

    My main problem is the Virgin Mobile contract that still has over £400 owed to them, all registered in my name & address. But this has definitely got nothing to do with me. Equifax contacted Virgin and Virgins response basically said they need me to contact them directly and this won't be removed from my report until it is fully paid.

    But I'm too scared to contact Virgin anymore about this incase they start chasing me directly for this money and try to take me to court!?

    If I manage to clear my name from all of this can I take action against Virgin for blackening my name?

    Have you contacted Virgin at all? Surely they can't just take a third party's word: "Our client claims this is a case of fraud". If they were to take you to court (unlikely) you can submit all the evidence to prove that it's not your debt.

    No 1 has blacklisted your name at all, speak to Virgin Mobile about it, you might even have to send the prove it letter (google) asking they prove it was you who took the contract out and hopefully the proof for example a contract wont have your signature.

    If it was for a mobile phone contract, Virgin will have details of where the phone was used. That can prove to them that it wasn't you if it's not being used near to where you are. They are the ones who have the burden of proving it was you, though. Probably have a signature on some contract that looks nothing like yours. It's convenient for them to claim that you have to prove it wasn't you but that's the wrong way around. It would also be convenient for you and them if you have a mobile contract of your own with another company, since it's pretty unlikely that you would want two.

    No need to worry about Virgin taking you to court. They would have to prove it was you who took out the credit and that's something they won't be able to do.

    You can't take action against Virgin for blackening your name when they appear to be the victims of a crime and just legitimately reporting what they believe. They will remove the record eventually.
