What Next ?

I overstayed in a Lidl carpark where Athena rule - apparently !

I have had the 3rd letter from Athena and decided to check out the forum - unfortunately I see the advise has changed since I last went through this process a couple of years ago - when the advice was simply ignore ignore ignore . Consequently I decided to follow the couple of templates I am now at the stage where I have sent them this

I write in response to your letter dated xx/xx/2013, refusing an appeal against the above noted PCN.

There is nothing whatsoever to prevent your company from accepting an appeal at any stage. I am aware that in many cases in the public domain, private parking companies have issued POPLA codes much later than your self-imposed 28 days guideline and indeed POPLA have confirmed that a code can be issued by the operator at any time.

Refusing access to your industry's alternative dispute resolution procedure would be unreasonable and a breach of the Civil Procedure Rules, as well as evidence of Athena failing to mitigate your alleged loss.

As far as I am concerned, I have made a valid challenge (28/07/2014). If I do not receive a clear rejection, along with a POPLA code within 35 days of the above date, I will regard the challenge as accepted and the matter closed.

Dear Sir/Madam,

With reference to your email, please be advised of the following:

We are contracted by the owner of the land to manage the site at which the parking event occurred and the charge was accrued.
The terms and conditions of the car park are clearly displayed on signs in prominent places.

All written appeals should be submitted within 28 days of delivery of the notice. As you have failed to do this we are unable to review your appeal.

As this is the case, we are unable to provide you with a POPLA code.

Your charge remains outstanding.

You can either send a cheque or postal orderto Athena ANPR Ltd, Po Box 306, Chertsey, KT16 6ED. Cheques should be made payable to Athena ANPR Ltd.

what is my next step ?

I am still within the 14 day period whereby I can pay the full £90 as I am loathed to do so .

But thought I would see what the latest advice is .

Correspondance is via email so getting replies quite rapidly even if they are pretty stock replies

    Ok you were too late to appeal. Window closed.

    Next step, ignore any debt collectors letters and continue to ignore.
    This is Athena, they to our knowledge they have never taken anybody to court despite what any debt collector letter say.

    And in the meanwhile go into a lidl armed with receipt and complain like made demanding the PCN be cancelled. Bank statement showing purchase is fine.

  • Much appreciated - tried in store but manager not interested and sent email to Lidl managing director but email advertised is no longer valid - surprise , surprise !!

    So I guess I just gotta pay up or take my chances by ignoring .

    Oh don't pay up. As I said, Athena don't do court! (Look at these FOI requests)

    Just collect debt collector letters and in about 6 months time they will give up. In about 3 yeas time they may try again, but will eventually give up.

    And complain to your local rag, google alternative emails for Lidl etc. Keep up the pressure, but do not pay!

    You can also communicate with people by making systematic marks on a piece of paper and requesting the Royal Mail to take it to the intended recipient.
