Advice on Refund Plz

I hope someone can give me advice on my problem which is.

Our property is part of an estate and there are supposed management fees each quarter. We have had major problems with them for the last 5 years and in fact they have carried out no work to our estate for about the last three years. We do any work necessary.

They are now to hand over the management company to the residents (they have told us they will do this for the last 2 years), so they have sent out bills to some residents. We changed our mortgage last year and in doing this we had to pay them the charges they said we owed. When I received no correspondance I contacted them, only to be told they actually owed me £230. I asked them for the money, and they have told me that I will not get it until all the other houses on the estate (about 150) have paid the monies owed.

I have complained, but they now won't phone me back. £230 is a lot of money to us right now and we could really do with it.

How can it be that they can withold my money?

Any advice on where to go or what to try next would be really appreciated.

    Citizens advice bureau?

    Is there anything in the small print about your money being subject to other peopel paying bills as this is unfair.

    do you have legal protection policy with your mortgage lender? If so phone their helpline and ask them if they wil cover the costs to pursue recovery.

    Thanks, forgot about the legal cover.

    Will try cit advice first and see what they have to say.

    There is nothing in the small print at all, and they have had my money for over a year now and I am getting really cross, it's difficult not to lose my temper.

    I'd be tempted to write a strongly worded letter saying you have no problems about going through the small claims court to reclaim the money owed and money for the managements fees that you've paid when they have done nothing. If they think it may cost them more they may pay out quicker.
