Back in the real world where people tend to take the easy option...
and don't work on the 5th or higher floor. Imagine that edict in something like the Natwest tower. By the time you got to your desk after having a fag on the way in and had the resusc team look at you it would be time to go home.

I think a word with your H&S rep as well would be in order.

Can this be legally enforced? I work on the fifth floor and we have just been issued with new building 'laws' for employers that state you may not use the lifts in work if you have just had a cigarette.

NB Yes I know I should just quit :o

If someone's a smoker it's impossible to tell if they had a fag 2 minutes ago or an hour.

Perhaps the employer has brought this new policy in, to make nipping out for a cigarette a less appealing thought. If you have to climb five flights of stairs each time you pop out, chances are that you will do it a lot less often than you would if you could use the easy option of the lift. Maybe they are trying to stop people abusing smoking breaks.

Also fairer for none smokers who aren't allows to keep popping out when they feel like it.
  • Surely such olfactory distress could be reduced by breathing fresh air for a couple of minutes prior to getting into the lift?

Problem is most smokers immediately enter enclosed spaces after a fag.

It won't stop their clothing or breath smelling, we have a smoker in our staff room, he smokes before he starts his journey to work and doesn't smoke while their (school so he can't) he and our staff room however smells of cigarette smoke as a result, it's absolutely disgusting.

I can't think of any law that would ban someone from using a lift after they have smoked. Have they also banned people with BO? ;)

Private property so "their house: their rules" applies unless, as said, you can argue some form of indirect discrimination

Boss: You've just had a fag and used the lift
    Underling: I haven't just had a fag
    Boss: Yes you have
    Underling: No I haven't
    Boss: Yes
    Underling: No

And so the morning passes quietly with idiots arguing the toss without a shred of evidence to be found anywhere.

Oddly enough as I'm not English and therefore have English as a second language no, but I'm also not going to bother using perfect grammar on a forum, just as I wouldn't in a text message. I'm not sure why my phone autocorrected there to their though.
