Can a car that has been abandoned be claimed by a member of the public and who would you approach?


The car is:


Out of tax
In a public parking area
Possibly been on a private plate
Been at least three months in same spot without moving
Owners have moved abrod

    Contact your local council to report it.

    Not sure you can claim it but you could always ask when you report it as abandoned.

    Send off for the log book. But be careful in case some irate person asks why your trying to obtain a log book for their car.

    Not without the owners consent.

    You could register it in your name, and become responsible for fines etc. but you will not own it, and the owner can claim it back.

    As it is on public land the Council have right of recovery, and can charge the registered keeper, and get it crushed.

    The DVLA will organise recovery, disposal and a fine in short order once it is spotted with no tax.

    I believe that taking it home, reporting it to the Police as abandoned property, and then becoming the owner after a set time does not apply to cars.
    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    This is a situation where it becomes a grey area.






    1.you know the owner is abroad, so this may go against you if they ever decide to come back!.


    2.you can ring the local council and report as abandoned, under the enviromental act 2005 they are obligated to remove, store and then destroy it if the current owner does not claim it during their notice period, but you can ask the council if you can claim it!
    3.you would have to do your due diligence, you would have to make sure that there is an clean entitlement, and that it is abandoned, by clean entitlement meaning the car isn't owned by lease, finance co, V5C loans owing on it, reported as stolen, you can apply for a new v5c once you believe you have satisfied that the owner doesn't have any interest in it, because you know the owner (this doesn't have to be personally know them but a neighbor you never talked to for e.g), you would have to go to great lengths in trying to contact them to make arrangement to move or get their permission to acquire it if your ignored, then go ahead and apply for the v5c, the DVLA will write to them saying someone has attempted to obtain a v5c for this vehicle, please contact us within 14days to confirm/not confirm transfer if no reply we will assume you are no longer the registered keeper/owner of this vehicle and go ahead and transfer keeper details the applicant, the legal responsibilities of a RK will then fall to you! you still wont own it, but you claim abandonment rights to the vehicle and are free to tax MOT and insure it and use it.


    If the time arises that the previous RK comes home and finds you have it, then he is to take you to court and battle it out there, this where your due diligence and detective work and attempts to notify them come into play so always make copies of every letter text phonecall e-mail you can.

    If in a public area probbably not. If private then its quite easy and cost about sixty quid.
