ESA Claim

I made a claim for ESA back in December time last year 2013 and didn't hear anything from them until I rang up 1 month ago and wanted to know what was happening and also to tell them of a change of circumstances with my wife's pay. So they sent out a form 5 weeks ago and i filled it out but didn't post it yet. Then my wife told me she wanted a separation so I rang the ESA to say that my circumstances had changed again and that I would be doing the claim as a single person, they said they would send out an Esa 3 form to complete and send back. But this was only last week on Wednesday but today I have had 2 payments from Esa £70 and £164. And I have 2 letters telling me what they are for and what my award is. I'm in the support group in the income related ESA.

Well I'm happy about that but I haven't been for any assessments and also where is my money from all those months before from December to June this year. I'm sure I should be entitled to backdated money.


I think the reason I didn't have an assessment was because I claimed Esa 2 years ago and have the same illness. But should I be entitled to the money inbetween these dates then?

    Does it say what date you have been awarded ESA from?

    Backpayment usually would happen - though it may not happen at the same time as initial payment. But...

    When you claimed ESA 2 years ago, what happened to that claim?
    Did payment stop due to time-limiting?
    If so, then it's possible your ESA claim has never actually been closed - you have simply been getting NI credits as your wifes income was too high for you to qualify for income-based.

    My understanding is that you would never be paid backpay on a fresh claim made in 2013, as you would not have the contributions for it in 2011/12 and 2010/11.

    The only way I can see that's semi-logical is that they've changed your claim over from in the support group but not being paid due to your wifes income, and just assumed you were telling the truth (or acidentally) and started paying you on that basis.

    In short - read the ESA letter.
    When does it say you were awarded.
    Did you get any earlier paper work from ESA?

    It's only possible for you in my understanding ) to get backpay, if the 2012 claim was never closed.

    So you got no letters, no ESA50, no payments and you didn't send in any sicknotes for 7 months ?????

    What do the letters say?
    Were you in the SG before on your old claim?

    You should phone ESA it will be a lot easier than asking us here.
