Hi,
I've been trying to improve / repair my credit report for a small while now and am getting bogged down quite a lot with the legalities of everything.
I am confident at constructing correspondence in a commercial environment but have no experience with legal documentation.
I have scoured the internet for help but often find conflicting information.
I have 5 defaults associated to me that I am trying to dispute:
BT - sent SARS and got very little info back. Disputed on Equifax and had it removed.
Motor mile - have requested SARS but have had noting back.
Barclaycard - sent SARS and got an awful of info back. Too much in fact for me to understand.
Barclay's - assigned the debt to Lowell but still showing a default (not debt assigned).
Lowell - requested SARS and again got very little documentation back.
Does anyone know please of an organisation / company that I can approach for help with constructing letters etc?
Oh, I forgot to mention that all debt has been paid other than Barclaycard which is partial settlement.
Thanks for any help.

Are you attempting to dispute the defaults?0

Yes. I want to dispute the defaults but I'm not too sure how to proceed with each one which is why I'm looking for professional help with them.
Thanks.0 -
There are plenty sample letters on the MSE website for various situations, have you looked there?
On what grounds are you looking to dispute them?
All you really need is a reasonably basic letter:
Dear Sir / Madam,
I wish to dispute a default of <amount> that your company has placed on my credit file.
I am disputing this default on <grounds>.
I wish you to <action you expect the company to take to rectify the situation>.
Yours Faithfully,

It will restore your honour, make you feel proud, protect your house, give you a job, clean up the neighbourhood, remind you of how great you once were, clear out the venal and the corrupt, remove anything you feel is unlike you... Thanks Gaz83.
The problem is though, I don't know the legalities and technicalities of why I want to dispute them.
For example, Motor mile have not responded to my subject access request. Which law or code of practice are they breaking by not responding? Or are they even breaking any code of practice?
Lowell are telling me that they do not need to provide documentation to support their default but I've read somewhere that data protection means that they must have all relevant documentation to support them filing a default.
These are just 2 examples which is why I'm trying to find a company to help guide me through.
Thanks0 -
Not responding to the SAR means you can complain to the ICO. Check out the ICO website, it has the info you need.
The company must be able to support the default. It should show up on an account transaction history as default notice issued etc, depending on the account type. Did Lowell issue the default or was it changed from the creditor when they bought the account? Lowell likely won't have all the account info, so ask original creditor.
You can send an SAR to Lowell, they have an obligation to respond. If you make the request specific, that's the kind of response you may expect.:beer:0
