    c-m The 5th and 19th are Saturdays. Day 15 would be a Sunday. Only weekdays count so NTK has to arrive Friday and that means posting on Wednesday.

    OP - you need to add that the 5th and 19th were Saturdays or they will miss the point. In fact add my calculations.
  • Hi I am a Newbie so apologize if this wrong thread to post. I am so grateful for all the advice seen here.

    I have just got my Private Parking Invoice rescinded. I spent a lot of time here on this site perusing and wrote several different letters:-

    1) For the issuer, I used the pro-former document from these Forums
    2) For the retailers visited I sent a polite request for help and copies of receipts for monies spent during period of parking.
    3) I found out who the landlords/ground owners were and protested the issue of such a ridiculous fine asking for their help.

    Every one of the above responded positively and offered to get the charges rescinded

    4) I wrote to my MP
    5) I wrote to the Newspapers (D. Mail & Times)
    6) I wrote to DVLA protesting at their release of my details from my No. plate photo.

    The retailer who got there first has my letter of thanks and I will buy her a bunch of flowers when I next visit. As I told her, I will come back, older, wiser & on roller skates!

    Moral of the story: Don't give up. Don't get nasty. Do lobby for this practice to be stopped. It's nasty trickery & opportunism not befitting this grand land of ours.

    That is good of you to post, and good news about your PCN. Well done for following the advice here, but it would have been better on a new thread as we try to keep to one PCN per thread.

    Thanks G D as C-M pointed out I did not receive a NTK it was just a reminder, have amended as you suggested:-

    1. No keeper liability under Schedule 4 of the POFA, I believe I am not liable as the first and only letter I received was a reminder that is dated the 19th July 2014 14 days after the alleged overstay in the free car park that had been recorded on 5th July 2014, both these dates are on a Saturday. (See copy). POFA says that 2 working days must be allowed for posting and that the NTK must be in the recipient’s hands within 15 days, 15th day would be a Sunday so the NTK should have been posted no later than Wednesday 16th July 2014 to arrived Friday 18th July 2014 at the latest. Clearly this did not happen and therefore keeper liability does not apply. I was not the driver on the day. I therefore respectfully request that my appeal is upheld and the charge dismissed.

    Is this ok to add to the rest and send to POPLA? I can post the whole lot again if needed..

    Got me truly confused now.

    I was assuming that you had not got a windscreen ticket and that the first communication you received about this was some 2 weeks later. If it wasn't a NtK how could it be a reminder? PE don't normally do that.

    The whole point is that if no windscreen ticket, then you MUST get a NtK within 14 days or no keeeper liability. So it doesn't really matter if it was a NtK, reminder or invitation to the annual Parking Eye office party, it was out of time.

    I wouldn't use the word "reminder" in your appeal point 1 as that would suggest that there was a previous communivation.

    Use the word "letter" or "communication" instead.

    Confused me too but it was the 'reminder' that was dated Saturday so the appeal point should not call it a 'Notice to Keeper'. It isn't an NTK, there wasn't one served (far more important to state that).
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    G D this is the first communication I recieved from PE:-

    PARKING CHARGE NOTICE REMINDER

    PARKING CHARGE AMOUNT DUE: £100.00
    PAYMENT TO BE MADE BY: ##/08/2014
    This parking charge is to be discounted to £60:00 if paid by: **/07/2014
    After this date, the full parking charge amount will be owed.

    Further to the recent Parking Charge Notice, this Parking Charge remains outstanding and you have until 24.July 2014 or the amount due will increase.

    On the 05 July 2014 vehicle ####### entered the Telford Bridge Retail Park car park at ****** and departed at ****** on 05 July 2014.
    The signage, which is clearly displayed at the entrance to and throughout the car park, states that this is private land, the car park is managed by ParkingEye ltd, that the maximum free stay authorised is 3 hours nil minutes, alng with other terms and conditions of the car park by which those who park in the car park agree to be bound.
    By remaining at the car park for longer than the stay authorised or without authorisation, in accordance with the terms and conditions set out in the signage, the Parking Charge is now payable to ParkingEye Ltd (as the Creditor).

    We would like is remind you that, if you were the driver at the time of the parking event you are required to pay or appeal the parking charge.

    Further information including how to pay, the right to appeal ect. can be found on the reverse of this notice.

    Go with your post #38 and you can even add a non compliant NtK as well !!

    You have enough with your full appeal, in my opinion, so don't run out of time and get it off.

    Oh - and from your signature, don't treat it as a downer - treat it as a great opportunity for a new phase ! :beer:
