need advice about a sanction on Jsa please

Hi I am new here and looking for a bit of advice
My partner claims JSA as a couple claim as we just had a baby four month ago.
On his normal signing day whichwas wednesday 23rd 2014 he was told he misses an appointment on the 22nd july which may I say he was never informed of yet Jc say they sent a letter on the 19th July which we never did as any appointments he gets either through post or at jc he hands to me so we can write them on calender.
Now on julu 26th my partner recieved a letter that was very short n sweet stating from 24th july until 20th august 2014 his Jsa had been sanctioned we are confused not about sanction but would he recieve the payment he signef for on wednesday 23rd july 2014 coz if im not mistaken Jsa is paid in arrears so if im right thaats from 10th july until the 23rd july and due monday 28th 2014 or is that stopped? muchly appreciated as I am a lil bit worried and getting into a flap

All payments are in arrears so as you have stated when he signed on 23rs provided all was ok with his jobsearch he will be paid up to and including 23rd.

You now have two other options. Appeal against the decision if you feel it is unjust. It is perfectly reasonable to post a letter to a jobseeker, it is written in law whether or not they accept your reason for not getting it. Very grey area cause how do you prove you didn't?
You also have the right to apply for hardhsip payments. You will need to complete a JSA10 and provide proof of no other income or savings, CT CHB are discounted but remeber JSA is not for your children so when you provide deatils about what you need money for if you states nappies or anything for children this will be disregarded. Some offices do face to face some you just hand in the form.
  • thank you both very much one of the advisors who my partner sees told him to go in at eleven on 28th and apply for hardship, all the CB and CTC goes onto baby aswell so i know i'm not short for her.I told him it was pointless appealing against it for sake of a month as it could drag on

Make sure you take the evidence required which is bank statements for all accounts both you and your partner have. they wont worry about birth certificates provided the child/children have been declared to BDC.

It is always worth asking for a mandatory reconsideration in cases like this and it may impact on any future entitlement or sanctions. You can still claim the hardship as well.
