Want to exchange a item but it has gone up in price?

Hi
Not sure where I stand so if someone could help clarify it would be appreciated.
In short;
I saw a pair of boots in the sale online and purchased at 50% off
I wanted a smaller size really but took a chance and choose the size above as I really wanted them.
I put a "wish list" request on the two other sizes so I would get notified if they came back in stock.
Today I got a email they are back in stock so I went to order them and they have gone back up to full price.
I contacted the retailer and they said it was new stock in. It is exactly the same item and same item code. I asked how could it be when they were exactly the same and how would I get notified if sale items are returned if the sale/new items have the same item code and he didn't know but took my number.
The question is; if I returned my item for a exchange to the size I want can they charge me full price? I can see how they are saying it is new stock when there is absolutely no difference in the item.
I'm just confused about my rights (if indeed I do have any).
Many thanks for your help.

You have the right to a full refund if you return the boots ( assuming you are within the time frame allowed for a change of mind return) , you cannot insist on a replacement in a different size.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. I think you meant to right can't there, based on the rest of the sentence. This is the right of the retailer, in the same way when someone buys at full price you are saying you can't see how it can be half price, as its the same product etc.
Same item, same stock, isn't really relevant, up to the retailer and entirely within their remit.0 -
Your statutory rights may allow you to return the goods for a full refund (depending on when you bought them).
You may have other rights under the retailers terms and conditions of sale, but without knowing their returns and exchanges policy it's impossible to say.0 -
Problem is, there is nothing requiring the retailer to sell all sizes of the same item at the same price and its not uncommon for unpopular sizes to be on sale price while common sizes are not.
At most any dodgy sales practices may get them a telling off from Advertising standards or trading standards but it still wouldnt entitle you to the other size at the lower price. You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
Thanks for all your all help it was very useful and I completely understand now.
Just to let you know I rang the company I was very polite and they were brilliant, they have offered a exchange at the sale price.
Even though they didn't have to when a company does this it restores your faith to order from them again.0 -
