Dunelm housing

I may be in the wrong place here but really need some advice and any direction would be great.
I bought a new build house on the 80/20 scheme from Dunkeld in 2009. I've had intermittent problems with my shower going hot and cold, this had been reported continuously to Dunelm throughout the 3 year warranty period. On several occasions they sent a plumber who just stuck his hand in the shower and said it wasn't going hot and cold. But I tell you when I was next using it it was! Believe me! At one point a guy did come with an electronic thermometer and recorded the temp fluctuating 10 degrees. No report was received by myself for this.
I've always believed it was the boiler. The boiler was never properly checked in my eyes.
When the 3 year warranty ran out and the problem was still occurring Dunelm basically stuck 2 fingers up at me.
I contacted NHBC and they said they would investigate. However on both occasions I reported it it tool so long for an investigator to come out the problem had resolved temporarily again ( as I say it is intermittent for a few weeks )
Year 5 and the problem is back. NHBC have been contacted again but I've been advised they may not be able to do anything as it is out of warranty. But the problem was never resolved during the warranty and I believe I have been fobbed off by Dunelm as I believe it is the boiler. A more costly repair than a shower valve. Can anyone advise me on what I can do or where I can seel advice?

    You can carry on as you are doing trying to get them to carry out a repair and have another five years of intermittent problems

    or

    You could bite the bullet and get a competent gas safe engineer in to look at the boiler and solve your problem, thus improving your quality of life.

    The second option might cost you a few hundred pounds

    The first option might cost you years of not having a good shower in your own home.

    Further to the suggestion by DaveTheMus (which is what I would suggest you do), there is nothing to stop you paying to get the boiler fixed but before the work is carried out, ask the heating engineer if they will be able to provide you with a written report stating exactly what the problem is.

    Once the boiler is working, there is nothing to stop you taking legal action against Dunelm or NHBC (I'm not sure which would be best or easiest) for the cost of the repairs.
    Providing that you have proof of your complaints since the problem was first noticed, you may well have a good chance of winning, but it's more likely that a settlement may be offered once you send a "letter before action". (if you search on Google, you will find many examples of what to include in this letter).

    Is it a combi bolier? Is the shower going hot and cold because someone else is using a hot tap elsewhere in the house?
