PCN got to me from December..can they do that??

Hi,
I received a letter from the above yesterday, with a PCN for £100, for an "offence" dated 17th December 2013. Apparently, as I had changed address,they sent one ( address supplied by DVLA) to my old address and I didn't get it. They have gotten my current address from a credit reference agency and sent it to me dated 12th June, arrived 23rd July.Offered me the option to pay £60 if I paid within 2 weeks. Today (24th) got another letter,saying that as I hadn't paid or appealled I have to pay £100 within 14 days. I've read the sticky thread and put together a brief response,which i will post (with proof of posting) tomorrow Can anyone look over the script below for me please??


"I refer to the letters received from yourself. Both letters, one dated 12th June and one dated 18th July arrived on the same day, 23rd July. This renders the appeal within “28 days from the date of our correspondence” as pointless. I have tried to initiate the appeal process through your website, since receipt of your letters yesterday which has proved impossible to access, as that option appears to be blocked from your end, although all other options, including payments are in working order…..
I do however wish to dispute this parking charge. My car was indeed in the car park for 19 minutes on the day in question. During this time numerous efforts were made to pay via mobile phone-the only way to pay- however as it was impossible to get a mobile signal, It was felt better to leave the car park and find an alternative, rather than park without paying.
I am therefore disputing this charge and appeal for it to be dropped. Should this appeal be refused, I will take the matter up with the POPLA

    I can't stop and write now, but if no one gets back to you be patient as this is not the best way to reply.

    Hopefully someone will direct you downa more sensible route.

    First do you have the envelope and does it have a date stamp on it?

    You need to write a first stage appeal to the PPC as outlined in the Newbie thread. (See my signature for details). Appeal as registered keeper of car

    Make first point in appeal that although the PCN was dated 12th June, it did not arrive until 23/07. Therefore you are exercising the right of appeal even though you received a follow up letter saying the appeal deadline had passed.

    Carry on with rest of appeal template and send to the PCN. THey may issue you with a POPLA code, they may not.

    Which PCN is it by the way?

    You could try and complain to the BPA, but I am not sure it will do much good, as if you hadn't updated the DVLA with your details, although it pains me to say this, it isn't their fault they couldn't contact you. They are persistent and have traced you in an alternative way , however by not sending the appeal within a day of issuing this, then they have not given you time to appeal. This is a matter for complaint.

    The mitigating circumstances of the situation will not win the appeal. And keep appeal in third person, no I did this etc.
