PREMIER PARK in POPLA thrashing.

I wasn't going to create a thread about a POPLA win until I felt that others needed to see Premier Park mentioned. They seem to be one of the smaller of the firms that we don't call SCAMMERS.
I was sent to a job at Bath Riverside. It's a nice redevelopment job in the centre of Bath. The block I was working in was mostly occupied but many apartments were still for sale. Premier had plenty of signs up about terms/conditions blah, blah. But as I was there to do work on behalf of the land owners I chose to park there. Several workers told me I'd still get a ticket but I told them that I knew they were so much toilet paper. Sure enough at the end of the day a ticket was attached to my car. Thankfully for the forces of law and order 'unauthorised persons' had refrained from interfering with the ticket and sticky wallet. £100 or £60 was deemed a fit amount for parking there.
Fast forward a few weeks and a letter arrives bearing a frightening 'DO NOT IGNORE THIS LETTER' on the front. I didn't.
Along with the usual drivel was the line. 'THIS LETTER WILL FORM PART OF OUR CASE AGAINST THE DRIVER.' Most amusing.
My return letter was pretty short.
My appeal stated that the car was parked there and as you have no proprietary interest in the land you cannot 'fine' me.
I told them they could either cancel the charge and write me a grovelling letter of apology or send me a POPLA code.
My scribing 'DO NOT IGNORE THIS LETTER' at the top worked because they didn't....Sort of.
Along comes a rejection showing they had given my appeal very careful consideration in the time it took to print their template rejection. Mr or Mrs Scrawl signed it and at the very bottom hidden in tiny writing was a POPLA code. Nothing to suggest it was actually a POPLA code though.
At this point my Mum became very seriously ill and I have spent the last few months in France where she lives. I had time to fire a skeleton appeal including GPEOL.
I hoped the case put up by Premier would be emailed so I could rebutt it but by the date of the hearing had seen nothing. So on the 3rd July I emailed POPLA stating that due to the situation with my Mother I had not seen Premier's case and would have to rely on my skeleton. On July 4th my appeal was upheld.
I returned to the UK on Tuesday and discovered no paperwork from Premier. They have not sent anything. This is not the first time. The Prankster blogged about the case.

So all in all Premier come across as a small shoddy outfit who fail to adhere to the rules.
Premier Park you can kiss my AZZ.:rotfl:
I should mention that the assessor pointed out in her ruling that Premier's evidence contained a breakdown of costs to counter GPEOL so they did fight it. However they were ruled as standard business costs.
I should also mention that I haven't yet had a grovelling letter cancelling the ticket. I'll wait......

I trust that you will be making them pay for their hubris. You never know how far you can go until you go too far.0

You should complain to the BPA - steve.clark@britishparking.co.uk and point out that - yet again - Premier flout the rules that require them to provide the appellant with a copy of their evidence in adfvance of the appeal being heard at POPLA.My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).
For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com0 -

If recent events taught me anything it's that some things aren't worth getting too upset about.
I will be taking it up with POPLA, the DVLA and the BPA though, HO87. I trust all three will deal with my complaints promptly. I also believe that Parking Eye will win ethical company of the year.:D0 -

Hi,
I live on a private property and premier Park also fine me for parking without a permit. I've written to them explaining I had the car fan on and didn't realised my permit blew off to the grown it was almost 01:00am the night I came home I do not use my car on a daily basis so I would have realised my car park permit had blew off the dash board . I wrote to them they refuse it ...I appeal through POPLA as they suggested and my appeal was also refused. I've sent evidence showing where the permit was and that it is still within date. I'm now told I have to pay fine within 14 day . I've been living on this property for over 8 year send I'm not stupid to just go and park on a property where I do not live. What should I do because I will not pay the £100 they are asking for any advice please.0 -

Hi Dee ,
I didn't know I was just following the advice they sent me ..I'm really mad with them because they are acting as if they are perfect. I have started a thread so finger cross. Thank you so much .0 -
It pays to talk. I'm back on the job where I received the Premier scamvoice. I got into a conversation with a couple of carpet fitters. They mentioned they'd just got a Premier scamvoice. The registered owner would have payed it. Step forward yours truly who has offered to fight it for them. Boy I'm looking forward to this.0

Just uploaded my POPLA appeal today against Premier Park in Southampton (see my other thread). Hopefully I can avoid the whole GEOPL hold up with Beavis and nail them on the nullity that is their NTK. No notice to driver so NTK delivered out of statutory time limit...
Or perhaps they will magic a Notice to Driver from thin air that I would argue is perjury!0
