    And Google does not say yes, it says a court may allow through given the circumstances.

    Yes, she will. You don't have to serve the Dad at all. Have you ever had to do it? I'm guessing not.

    If such practice is happening, then it is not legal. That's the whole point of having PR, to gain some legal rights over your children, which means that any legal changes can't take place without approval from those with PR.

    If OP had such an issue about the father at the time, she should have gone and registered the children without him. By not doing so, she made a decision that would affect her children for 16 years whether she regrets it or not.

    I personally find it terrible that parents selflishly play with their children's name. The surname they give their children is no longer the parent's name in the children's mind, it become THEIR name and messing about with it is nothing else than imposing their selfish desire. If a child has an issue with having a different surname to their mother, that's because this feeling will be fed by the mum.

    When my kids asked why they had their dad's surname (separated after only a couple of years), I explained that at the time, we had to choose one or the other and decided that it would be nice for them to have their daddy's name, but that the moment it was written on the register, it became THEIR own name. They now don't see it as daddy's name vs mummy's name, they consider it their own surname and that's how it should be.
