  • hi! i have an ongoing court case with rbs. i actually won my case but as an error with the court date was found i had to go back and start again. its been going on all year and is scheduled to go back to court in march. the banks lawyer turned up at the last court date and said he wanted it put back until march next year and when it goes ahead he said he was looking for a 3 day hearing ??
    i have also to get a lawyer as i cant represent myself . does anyone know a good lawyer in the slye and lochalsh area?? and is the 3 day bit true??
  • Sorry but as there is as little information in this newer post than your previous posts no-one can advise without the full history of your case.

    As you already had someone else dealing with your case I can only suggest you go back and ask them as this doesn't sound like a straight forward reclaim case as you didn't seem to even know the amount you claimed or in fact won.

    ofcourse i know how much i claimed and then won . theres nothing straight forward about my case no. i won the case then it was recalled by the bank becos of a mistake made by the court staff. and as i already told u by pm which u ignored i am claiming 4000.00 and my court case was for 1500.00 which was the amount u could claim in scotland at that time. the person who is helping me is a long way away so that is why i came on here to ask for help . hardly a crime now is it>?

    In order for anyone to give advice, you need to explain clearly what has happened so far. Unfortunately no-one is clairvoyant, I have just read both your threads and frankly I'm none the wiser, so you need to spell it out .

    If need be type it out in Word and then paste it on your thread
  • i started a case against the rbs last year . i claimed back £1500.00 . i won the case. i sent the baliffs in to get the cash. then the bank recalled the case on the grounds that someone in the courthouse had made a mistake .( the bank was sent a different date than i was to appear in court) . i went back to court the judge put a sist on the case. i went back to court again to have the sist reviewed but as the judge knew nothing about bank charges he deciced to keep it on sist until after the big court case in england. im goin back to court on the 25th feb to have it reviewed again .
    the last time i was there he told me to bring a lawyer with me the next time i came .
    i need a lawyer that will represent me and come to skye to do so.
    the full claim is for approx £4000 i only claimed £1500 becos that was the amount i could claim for at the time. i know it has gone up since then.

    So is the hearing on Feb 25th for £4000 or still the original £1500. Is this Small Claims or Summary Cause?

    he told me to bring a lawyer with me the next time i came .

    I don't understand why he said this if it's small claims and the hearing on the 25th is to review the sist. As I've already said you need someone with better knowledge of the Scottish system to advise you, although leaving it till the last minute doesn't help.
  • i havnt leftit to the last min at all . i first asked for help with finding a lawyer on the 30th dec. as i said im getting desperate now becos i cant find one . :mad:
