Mobile phone's faulty/ still under contract

    Yes, you bought an iPhone AND minutes.

    They are still giving you the minutes etc, so they continue to charge you for them.

    Then under the SoGA they have to refund, repair or replace the handset essentially at their discretion, if the fault is inherent.

    It's quite simple really, if they had blocked the SIM and refused to send another, they would not be providing the minutes and you would have grounds for a refund on the service. But that's not the case. So you only need a remedy for the iPhone - the faulty part of the contract - and I've told you how to do that.
