Cooker not as described - what are my rights 4 months later

Hello

I might have already posted this somewhere but i can't find it so i will go again.

So, I purchased a Range cooker from a well known online appliance dealer in march. Cooker was delivered as planned, no complaints there. We ended up having to do a larger amount of remedial work than expected before we could fit the kitchen so kept the shiny new oven all packaged up in the living room. Kitchen finally ready for the new oven and was fitted on the 9th of july. Today we have given the oven its first thorough workout and have discovered it is not as described by the website.
The website describes 1 main fan oven with secondary fan oven (the reason for our purchasing of this model). Upon our cooking today we have discovered the secondary fan oven is in fact a convection oven.
As you can imagine, we feel a little put out and annoyed by this so will be contacting the supplier first thing tomorrow however, i would like to have an understanding of my rights before hand. I have had a read of the consumer stuff on this sight but it didn't really answer my questions. I have taken screenshots of the web pages today to help our case. We are not necessarily after a refund, just what we thought we were paying for.

I have since been on the manufactures website and they DO have the real spec listed….

Any advice will be gratefully received.

    After 4 months im not sure you can reject it , the fact its only just been installed is nothing to do with it.

    It could be considered that after 4 months you have accepted it in the condition it is in, the deviation from the description could reasonably have been found before now.

    Worth a try. Try and get evidence to show that you were unable to install it b4 now and that might work. Otherwise you have no evidence to show (to the contrary) that the device was tested upon receipt and so acceptance has likely occured
  • well, i thought i would have greater protection than that.
    I was under the impression that i had been mis-sold the item therefore the company should do something about it.

    Have you secured a copy of the dealer website description, just in case they change it and deny it ever said it was a fan oven? You can use WebCite to make an archive copy of any web page.

    They should do something about it, and it's likely a court will find in your favour. But given the timescales involved, it probably will have to go to at least threatening court proceedings before they act.

    Personally I don't think the time scale should even come into play. If they had used the oven for four months then found out (i.e no need of the second oven) then it might be a problem, but they havn't used it(well apart from a couple of times before realising), it was still new ~ paper work to say it's been fitted...

    I don't know the legal side of things being 'mis sold' but the time scale should be irrelevant here.
    People don't know what they want until you show them.
