For anyone with PE PCN at South Tyneside Hospitals

I've been trying to get a copy of the contract under FOI. They refused originally under the usual exemptions which I challenged and asked for internal review.

They've responded today but only with a redacted copy of the amendments to contract, not the contract itself.

However, rather oddly there is a glaring mistake;

https://www.whatdotheyknow.com/request/215656/response/542151/attach/2/1994%20Redacted%20contract%20amendments.pdf

they are inserting clause 2.1.5 which includes;

.........Parking Penalty ("the Parking Charges") may be issued......

    You must insist on the full contract. The ICO has ruled that where a contract has been negotiated between an NHS Trust and a private company that contract is as much the property of the trust as it is the private company, and as such is subject to FOI disclosure.

    Nice to see you back martmonk, and well done on your persistence. Keep us posted.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • It took a while but the trust have now provided what they believe to be a full response to this FOI request.

    They are using the standard 2010 contract, plus amendments as posted previously.

    I've started a separate request for the vat invoice details so that we can understand just how many people are being fleeced and how much is being taken from the local economy. Those numbers will be the focus for local press, mp and the CEO which is a major part of what worked at Northumbria.

    For anyone who's not seen a parking eye tender response before there's some interesting drivel.

    That's good work again, martmonk.

    I read the tender rubbish and was more concerned about the words from the NHS Trust which included calling it a Fixed Penalty Notice and even worse, that the contractor has to 'abide by the DDA if there's a barrier system'. The DDA doesn't exist. Haven't they heard of the Equality Act 2010, they are a poxy Hospital! And what about abiding by disability law even if there isn't a barrier system (i.e. Parking Eye's system).

    Where is any concern about disabled parking bays, didn't see them even considered...yet it's a Hospital?!

    The tender says the NHS Trust keep the P&D money (so they are the principal I would say).
