    Thank you everyone.

I am not a business person

Whether you think it or not this is a business transaction, you don't get to decide that.

The good news however is they have breached the contract not you.

In reality you can if you want to play them at their own game and keep the deposit until you mitigate your loss, I,e resell the kitten.

You can also keep any expenses incurred doing this but if you get the same price without incurring an expense then you refund the whole deposit, again it may be petty but feeding the kitten is an expense you could claim from the deposit.

They are in the wrong, just tell them they breached the contract and that is your final decision.

The contract does not say any particular kitten but all previous emails show they enquired about a girl.

Then this is all the proof you need.

It it ever went to court, you have proof they wanted a girl and so that's what the deposit was for. That's all a judge would need (but I really can't see them taking it that far anyway).

As others have said, send a cheque for the deposit back to them and say you consider the matter closed.

Just had to google a Tonkinese as i had never heard of them before...and realised thats what my neighbour has lol...she's a little scrap of a thing with the courage of a lion. Her daily entertainment is walking slowly around the top of our back fencing with a smug look to torment my yorkie....
I remember when they got her approx 2 years ago she was 6 months old and got into a fight with a dog around the corner she chased it and dived on it's back lol....she came off worse in the end she came away with a broken jaw...walked around showing off the pins that were put in place.

I'm not a cat person but if i converted i would defo get a Tonkinese...Beautiful cat with personality!

Don't let them anywhere near your kittens..

Completely OT but what is the difference between a Tonkinese and a Siamese? My Aunt had what I assumed to be a Siamese when I was a child (though it looked like a Tonkinese now I've googled). She was the most regal, uppity cat I have ever come across and lived to the grand old age of 22, still calling the shots from her palatial cat basket to the end.

I'd love one, but we have a terrier and DH isn't a cat fan sadly.

I was always the anti-cat person in our house, but at the weekend we got a Maine Coon kitten who is great.

What bothers me with cats (and I realise this is ridiculous) is the lack of control you have over them as an owner. it would honestly terrify me when it went out and I'd probably spend the day worrying over whether it was being run over, shot by local idiots etc. Of course a house cat would solve those problems but again I'd be worried about leaving doors open in summer etc
I just worry too much I think. :o If I could get past those issues I'd probably come home with a 'stray' and flutter eyelashes at DH until he agreed :D

I like the independence that cats have - they don't need as much attention as dogs. That said, the only reason we got a cat instead of a dog is because our landlord won't allow them.

If you do breed again it would be better not to show potential owners any kittens other than those that are available for them to purchase.

Then there is no prospect of the people wanting them.

I have not bought a kitten but have bought pups and have only ever seen those that were available, not any who were already spoken for.

When I said I wasn't a business person I meant that i don't have a business head not that the act isn't considered a business transaction.

I make no profit from this, I do it because I enjoy it. Any money left over after kitten sales gets ploughed back into the cats to keep them healthy, screened and free from disease.

My kittens are born and brought up in the house. They are allowed full roam of the living areas and at 8 weeks will be in the living room in the day time. I think it's important to show buyers the kittens at play and interacting with one another. I'm not a fan of being bought kittens to view from another room as I want to see them with their mom and see how they live. I have seen many a breeders home and I have seen both ways. The only kitten we bought that was brought out to us as the kitten we had enquired about turned out to have a lot of socialisation problems. He was not good around other cats at all and not house trained. For me, seeing the kitten in its home environment is most important.

If I continue to breed I will ask that a form is completed prior to arranging viewings in which they specify which kitten or type they are interested in and in which I state that other viewings will be arranged using this information so if they change their mind on viewing then they will effectively join the back of the queue.

The one issue with these kittens and this family is that all the girls are tortie coats. Due to genetics, they always were and this was clear in initial emails but also on our website. This families reasons for not wanting the girl are that they are not fond of torties (or rather the man isn't, the women really loved one of the girls). So I suspect he said you can only have one if it's a boy.

Tonkinese are a breed in their own right that resemble the original thai street cats that came in 3 coat patterns. Years ago the pointed (Siamese) and solid (Burmese) were bred from developing two single breeds that have changed somewhat over the years. Tonkinese have 3 coat patterns, pointed, solid and intermediate. They are developed from originally breeding a Siamese to a Burmese. Then breeding the offspring to another Siamese Burmese cross....

    Hope that helps.

Just wanted to ask... The people saying that they don't have a leg to stand on, so to speak. Is this educated advice or are you pretty sure?

Thank you all so much for all your help, I have been in a right state for two days and not slept at all.
