I think i might be losing the plot! :-(

I'm not sure if I'm looking for advice or having a rant but either way thankyou for reading!

myself and ex partner applied for a transfer of equity at the end of March - the mortgage to be transferred into his sole name.

Forms were filled in and sent to the solicitor dealing with it, i spoke to them numerous times and they confirmed that on the 15th april all the documents needed were sent to the halifax and halifax had received them - nothing more they could do it was out of their hands now.

I rang the halifax numerous times for an update of when i would be removed but every time i rang i would get the usual "sorry, we cant discuss this with you as its being transferred in your ex partners name - he will have to ring for an update" - well that was never going to happen he wasnt about to do me any favours!

Anyway the weeks went by i was getting more and more annoyed and eventually got some sense out of the land registry who confirmed that on the 20th May the property title deeds were no longer in my name and were in his name only.

Rang the halifax back and again got the "we cannot discuss this with you"
I begged and pleaded and said that the land registry had confirmed i was no longer on the title deeds - thats it then she said, you cant have one without the other you will definitely have been taken off the mortgage then, you should receive confirmation via a letter in the next week or so to say youve been removed.

So i can start looking for a house and apply for a mortgage in my own name with someone else?? Yes she said.. ok but what about it showing up on my credit file still? it will take 6 -8 weeks to be removed but you should be ok as whoever you are taking the mortgage out with will have ways of seeing you are no longer attached to it.

Fine i thought! went house hunting, found a property - had a DIP accepted and went for full application. Passed credit check and all that was needed now was my proof of identiy.
Was assured that as soon as my identity documentation was received and valuation went ok that thats it, mortgage should go through no problem.

Had an email today (after much faffing but thats another story!) to state that they cant procede until I send them proof that i have paid off the mortgage - so i replied with i havent paid it off - i was taken off - fine, but we need proof.

On the phone to halifax again I go for half hour on hold to be told again "we cant discuss it wtih you" so i lost the plot a little and they eventually told me that no actually i was STILL on the mortgage but they cant tell me when it will be progressed further?!!

What the heck do i do now?! surely my new mortgage is going to fail if i cant provide proof that im off (which i cant because im still on there!!) and aside from that the vendor is going to get very annoyed as its three weeks in and still no valuation booked!

I'm really sorry this has been such a long post - i genuinely dont know what to do next :mad:

    Hello,

    Wow what a frustrating faff you have been through! Not sure I have much to recommend but can you speak to your financial advisor if you have one? And maybe ring through to complaints with Halifax or demand to speak to someone higher up in the company about why this hasnt been done yet!

    Then your ranting is most likely misdirected. I would say that your ex partner has been unable to obtain a mortgage in their own right. A matter which the bank quite rightly has no authority to discuss with you. Mortgages aren't just simply transferred matters are somewhat more complex and may well have been impacted by the new MMR at the end of April as well.

    He has been able to obtain a mortgage ive seen the paperwork it's just the transfer that's not happening.

    Finally got to the bottom of it and the solicitors have two parts to do which no one seemed to realise and they didn't do it.

    That's now being done and I've no idea how long it's going to take now or whether my new mortgage will be prepared to wait

    Yes as far as i know - he went in and signed some things and as far as i know he is just waiting for me to come off the existing mortgage before the new one can proceed but everyone seems to have differing views about the next part of the process and no one will speak to me at the halifax (even though at present I am still on the mortgage!) :mad:

    A letter from the solicitor confirming the transfer of equity has taken place and you have been removed from the mortgage should suffice.

    You do not need anything from Halifax.

    As far as i know they solicitor sends all they need to send to the halifax and then its out of their hands - they dont receive correspondence to say its been done??

    I suggest you ask your new lender what it requires and see if letter from solicitor is on the list of items.

    It has been accepted by other lenders on TofE cases I've done in the past, but I can't tell you what your lender will, or wont accept.

    A solicitor is required in order to register the transfer of ownership at Land Registry. Nothing to do with the lender at all.
    Where There is a Mortgage to Repay

    If there is a mortgage on the property which is to be repaid as part of the transaction, whether using money supplied by an incoming owner or via a remortgage, then it will need to be repaid on or before completion and a discharge document in for DS1 will need to be obtained from the lender. This will need to be submitted to the land registry with the AP1 application. A redemption statement, calculated to the day of completion, will need to be obtained prior to completion to ensure the correct amount is paid. If the mortgage is not redeemed in full the lender will not release the DS1 and the transfer will not be able to be registered.

    apparently its the TR1 that the halifax are waiting for from the solicitor. Once thats been received then they can proceed but how long it will then take they cant tell me..

    TSB have stated they need to see proof from Halifax that ive been removed, not from the solicitor, but still no one can tell me how long this will take....

    The land registry have confirmed that im no longer on the title deeds and that it is in my ex's sole name.
