Hi guys im new to the board and i really need your help, i have an ongoing claim with barclaycard re:ppi. This claim has been going on for over a year and is currently in the hands of the ombudsman. i had correspondence from the ombudsman asking me to confirm some details but i am at a loss at what to return back - my application for the card was taken out in early 2006 and i do not remember ever signing up to this protection - i only questioned the policy when "optional payment protection" appeared on my statements when questioning this the claim process started. barclaycard are refusing to uphold my claim and i am so annoyed as i would never have been able to use the policy and i dont recall asking or agreeing to have it.
The ombudsman have asked me to confirm where i was working at the time, how many hrs a week i worked, if i was paid sick pay (which in most jobs i have had ive been lucky enough to have this) and if i had any pre existing medical conditions.

I dont want to return any correspondance unless i am certain of my reply but i cannot remember exactly where i was working at the time or any of the finer details.

I am genuine with my claim and i really want to ensure my response does not ruin my chances (i am not a form filler and i am also not great with words as im sure u can tell!)

Can anyone help me to decipher why this info is required and help me in how i should respond?!

    Someone wiser than me will no doubt be along shortly, but I can't see how any of the information that you've been asked to provide is pertinent to your complaint?


    Have they written to you to ask for this information specifically?
  • Yes the ombudsman have requested these details but exactly as u have noted i dont see how it is relevant, i raised my complaint as i dont recall taking the policy out - i applied online and from what i understand it was a pre ticked box. i want to be sure of my reply before i do so. i requested proof from barclays that i did indeed request the policy along with a signature etc and they failed to reply and when i contacted them they stated in their eyes the case was closed. this is all becoming very annoying as i am a genuine complaint... :(
    When i know people who have received their money back with no question! :(

    Why would you not be able to use it?
    recollection can be patchy which is why evidence is important. Memory fades.

    Dont lie. Dont guess. The FOS expect you to lose recollection over time. So, dont be afraid to say you cannot remember.

    When you make a complaint, they dont just have to consider your complaint but all aspects of the sale. Where there is no identifiable failing, they then look at other areas to see if there were any issues there.

    It would suggest that your complaint reason is heading towards a rejection and they are looking at other areas to see if there are issues there (if your reason was likely to be successful, there is no need to look at other areas).

    Was it a pre-ticked box? The FOS would check with BCard. However, it could be that it wasnt and you cant remember. After all, you cant remember your employment at the time but you can remember an online application from 7 years ago. (giving you an idea of the issues, not making judgement).

    Why did it take you seven years to complain? Whilst timescale is not an issue in itself, you do being to lose some credibility if you query something on your statement after it has been on there for nearly 100 statements.

    Auto payouts are a pain for people that dont benefit from them. You can see people without genuine reasons getting payouts whilst others who may be genuine but lack evidence not get a successful complaint.

    If this was definitely the case then the Bank should have already upheld your complaint. It would be foolish of the Bank to reject in those circumstances, knowing that the Ombudsman would overturn the rejection and mean them having to pay you AND the FOS fee. Why do you "understand" there was a pre-ticked box? These weren't always used and their use was discontinued.

    As Dunstonh said, the questions being asked are not irrelevant, but would indicate that the adjudicator is wishing to look at your circumstances at the time to see if there are any other failings with the sale of your PPI which is not in your complaint.
