Chargeback: Faulty goods?

Hello, I hope you're all well!

So, I was wondering if anyone could help? I bought some toy cars off of eBay and they became faulty. The items were fine and now aren't charging, so literally duds.

Spoke to the seller, they agreed on a 40% refund. I agreed, couldn't be bothered faffing around. And they've gone dead.

Its been more than 45 days so can't go down the PayPal dispute route.

Spoke to lloyds and they opened a dispute, only for them to close the dispute today saying they can't take on a chargeback as the item has become faulty and wasn't delivered faulty?

As I paid by Paypal, I can't do a section 75 claim can I? I'm just lost and don't know what to do.

Any help would be amazing and I thank you in advance :)

How much did they cost? If less than £100 no S75 refund I'm afraid.

    Hi!

Thanks for replying. They were £238, can I so a S75 claim?
  • I would hurry up and try. I thought there was a 30 day limit for a lot of these claims. It's unfortunate that this didn't happen until day 45 so you should at least try as soon as possible.

    It's 120 days for chargeback, not 30.
There is no such time limit for s75 claim, but most likely it will be rejected because Paypal was involved in processing the payment.

Unfortunately you paid PayPal £238 to transfer £238 to the seller. Therefore your S75 protection is over if PayPal transferred these funds or not.

You could take a punt and try anyway but they will almost certainly reject the claim as your payment was to PayPal and not the merchant

Have you tried Paypal's buyer protection?

    Edit

    Just noticed this eligibly requirement:-
Buyers must raise a dispute within 45 days of a single PayPal payment for the full price of the item. If no satisfactory response is received from the seller, a claim must be filed within 20 days of raising the dispute
