Law on refunds when Debit card is no loner in use

I paid for something from my local B&M £2.99 for a garden Meercat thing. That was broken. I took it back a few days later for a refund and they insisted that I have the refund back on my debit card. Only trouble is I didn't have that card any more. I broke it the same day and handed it back into the bank for a new one. Do they have to refind the card ?

They refund the same method as paid....just get either a credit note, another garden ornament or something else for £2.99.0

I do not believe there is anything that requires them to refund in exactly the same way the original payment was made, and given it is reasonable that cards break or accounts are cancelled I don't think it would be fair to refuse a refund because of that, especially if acceptance has not occurred and a customer can insist on a refund.0

When you get your new card it will have the same number as the old one, just wait until it arrives then go get your refund.Accept your past without regret, handle your present with confidence and face your future without fear0

Yes I did hand it back, but they have taken so long. The shop never offered me an alternative. Anyway does anyone have the LAW on this please ?0

There is no law specifically pertaining to this.
The Sale of Goods Act entitles you to reject the goods for a full refund. The technical term is 'rescission of contract'; you should be put back in the position you were before the contract was taken out.
The act makes no mention of payment method. If you paid 2.99 sterling, you should be given this back. If you bartered a camel, you should get this back. But it appears you cannot be put back into the same position as before, as you no longer have the card to replace the money on. This is not the shops fault.
Now I would argue they are being over-zealous in applying the law. From your perspective it makes little difference if you'd been given cash or card refund. If it was a large amount of money and you went to small claims court, you'd almost certainly win.0 -
