Salary sacrifice car fuel expenses question

Hi,

I'm not sure if my question is in the right section but I have a question about claiming mileage expenses on a salary sacrifice car scheme (SSC).

The company I work for offers a SSC scheme and states that all mileage claims for car leased through this scheme must fall in line with HRMC rules. The HMRC mileage rate is lower then then the mileage rate for a private car owner using their car for business use.

My partner works for a different company which also has SSC scheme but with one difference, this particular scheme will allow for cars to be leased by employees for their partners/family members even if they work for a different company.

I was wondering if my partner leased a car through her work SSC scheme for me, if I would then be able to claim a private car mileage rate for business travel from my employers? I couldn't find anything in the HRMC website to say I couldn't but then again there was nothing to say that I could. My company rules state that I can only claim the reduced HRMC mileage rate when I lease a car through there SSC scheme only.

Any advice would be appreciated.

    These things depend on if the monies are coming from your gross or net pay.

    I a former client did car leasing as part of its business and so had a "friends and family" scheme for employees. It came out of your net pay and so is 100% a private car and you'd get the private car rate even if you got it for yourself.

    Employees of a certain grade could have it as a company car instead in which case it came out of your gross pay but you had BIK to pay on it and mileage would come in at company car rate.

    I'd strongly suspect her friend and family scheme is the same in which case its a private car and you get private car mileage.
