Refunds

I bought binoculars from a local shop. After a couple of days I decided I wanted a more expensive pair. The shop didn't have any in stock so the manufacturer agreed that I could send them back to them and pay an extra £50 for the more expensive pair.

I received the new pair two days ago but they aren't what I expected. Am I entitled to a refund of the whole amount from the manufacturer since I sent back the original pair which they accepted as brand new?

    I'm expecting an email or call first thing tomorrow so would like to be prepared :)

    You aren't entitled to any refund, unless the binoculars are misdescribed, faulty, or not fit for purpose.

    Oh really? I thought since I ordered the binoculars over the phone Nd paid extra to the manufacturer , which sells over the phone and online, I would be covered under Distance Selling??

    Even if you were covered the most you would be entitled to is the original pair back and your £50, minus whatever the deduct for the lower resale value of a used pair.

    You never paid them the full amount so can't expect a full refund.
