neighbour using house for business

hi, looking for advice on what to do about this.
my neighbour is working on vehicles from his garage 24/7, he is also selling vehicles from the street
the street is a 40mph and quite dangerous and we are having trouble getting out of our drive cos we cannot see round his vehicles, it is also noisy, sometimes he works until 11pm

is he allowed to do this?
his place is rented, if it makes any difference

    there are tax discs in them, but i wouldnt know if they are insured :)

    Maybe...maybe not. You would need to speak to your local council to see if he can or cannot. Environmental health might want to check he is disposing of any waste correctly and not using the domestic service.

    Council byelaws are different everywhere they may allow one car to be sold on the street if he is the owner of it....then again if you can get all the registration numbers of all of the cars you have ever seen sold on the street that may be a precieved as a business and not permitted.

    Renting or owned that doesn't make any difference. The landlord won't be too worried about it as long as the property is returned in the same state it was initially let in then it doesn't concern the landlord. If you know the landlord then try speaking with them. If you can say something about the property getting damaged then tell the landlord they might then evict the tenant to prevent further damage.

    landlord lives at the other side of the country and is only bothered about the money. he told me that when he let a drunken, foul mouthed couple live there. mind you they wrecked the place and he was left out of pocket ....

    My husband used to have a car which was his hobby but used occasionally for wedding hire. It was garaged elsewhere, but he brought it home a couple of times to clean .


    A neighbour, who had a grudge against us, reported that he was running a business from home, which he was not, but we got a stroppy letter from the council, saying that a business should not be run from home, without their permission, and that, if asked for, it would be refused.


    This was a single car, mainly a hobby and being on our drive inconvenienced no one, so the OP should have a case, as they experience nuisance.

    1 had the exact scanario with a neighbour. He is running a business from the house which he wont have planning permission for. You therefore need to speak to the planning department at the lical council and register a complaint. They are duty bound to inspect and can issue an enforcement notice.

    Also ring Environmental health as Happymj says.

    A call to the police wont go amiss if he is parking his cars on the street as I can guarantee that not all of his cars will have tax, mot and insurance.

    Also ring Fire Brigade Headquarters and speak to someone in enforcement. If he is running a business without appropriate fire controls such as fire suppressants, fire exits, storage of hazardous materials etc, they can issue a prohibition notice and he will have to cease work immediately.

    Happymj is wrong in terms of the landlord. His lease will bar him from running a business. Getting the landlords details via the Land Registry will be worth the £3 fee.
    Eat vegetables and fear no creditors, rather than eat duck and hide.

    It was quite a few years ago, but I'm almost sure that it didn't give a reason.


    Usual refusals for taxis (which this could have been, but wasn't) are on the grounds that extra traffic and movement at unsociable hours cause nuisance for neighbours and our council reprimanded a man who was reported for doing metalwork in his shed at unreasonable times (the story reaching the local paper, as he thought it unreasonable, because he was on his own premises).


    The council will not be pleased, if your neighbour is running a business without their permission and not paying business rates, even though they don't get the revenue.

    I've just spoken to my husband who says they didn't give a specific reason , but quoted the the Town and Country Planning Act.

    phill, thanks, will do. landlord is not interested at all. as long as he gets his money. i rang the letting agent but they do not care as they are not managing it, the landlord is. they past msg onto the landlord and he has not been in touch - this was 2 months ago and nothing has changed.

    had not thought of the fire risk . eek. his garage is attached to mine, he had better not burn it down!
