they will deny your appeal simply because you did not make it within 28 days of the ntk, so how can this be a quick process ?
I already said they can pursue you for up to 6 years under the small claims court service, so again thats not a quick process
I dont think you understand any of this despite the NEWBIES thread explaining a lot of it
you allege you owe £12.50p, they will say you owe say £100 (bpa cop) or more if the debt collectors are involved or if the court becomes involved
its your word against theirs, that can only be decided in a court of law , they control the process (if you do not pay) , so you are the puppet on a string that they have dancing around simply because you did not appeal within 28 days , which would have allowed you a popla appeal and let popla decide , so you are in this predicament due to intransigence on your part and nobody can help you turn the clock back and there is no simple answer to your problem, other than paying
I do not advocate paying so I agree with post #7
but you are going round in circles now
the simple fact is, if you wish to have an argument and its about "he says, she says" and your dispute is over owing £12.50 instead of £100 , the small claims court is where it is decided, nowhere else. that is the time you get to put your side of the story and have your say, where you hope a district judge will agree with you
doesnt matter what the paperwork says or the forum says, only what the judge says , on the day, in court (if it gets that far) , in his or her final decision (the judgment)0 -
Thank you for your thorough reply. So the best thing is to appeal to them in writing, expect it to get rejected, then wait for however long it takes them to take me to court (if they actually do). This could be up to 6 years. So where do the debt collectors come in too? I have read the newbie thread it iss very helpful but I read it to be a bit disorganised for a newbie like myself to understand really.0

better to have the info there, than not have it at all
debt collectors are the halfway house that are tasked by people or companies to chase up alleged debts , some people dont bother using them , others do as may be the case here
some companies like PE are now going for the jugular by not using DC and issuing an LBCCC and then an MCOL , which is a much shorter time frame and never 6 years
that is why post #7 was short and to the point
ie:- put up or shut up (to apcoa)0 -
The only thing I am really bothered about is the fact this letter has come 10 months after the incident and they have said that if I do not pay within 7 days they will refer to debt collectors, now whether they use them or they pretend to be them, will the charge not go up? I definitely do not want to be receiving letters saying I owe them 100's of pounds for DC fees etc.
So If I appeal, especially as I can only do so in the post, will that not take over the 7 days they have given me and the appeal will get rejected but still get asked for more money due to fees? That is why I am not sure about this because of the time it takes to appeal etc will overun their 7 day period and incur more charges.0 -
Debt collectors have as much power as my mother in law and she's 880
-
it matters not if they increase it to £1000 , if it went to court and you lost it would be only about the same as any debt collector charges , so as its been ignored this long I dont see how a few letters from debt collectors can alter anything at all when they have no powers to act, they cannot even leave a horses head in your bed !!
to be honest, I wouldnt even bother reading them apart from checking if any are an LBC from an actual solicitor , or an MCOL from northampton or salford
anything else you file in a large envelope for 6 years along with the previous paperwork (in case you need it all for court) - after 6 years it is shredded and goes in the blue bin (well it does here - the paper recycling bin is blue in my area) - lol0 -
Sorry to tell you - that is what you will get but it's only letters, like phishing emails! So what? We have ignored these letters for a decade and you missed a trick by not appealing and using POPLA - if it was offered on the 'parking invoice' they sent you (as yours wasn't the usual sort of PCN). I say again, so what? They are letters, big deal, I have a collection of mine from the years before POPLA was available for appeal. Everyone here on this forum always ignored these letters back in the day and the sky didn't fall in.I definitely do not want to be receiving letters saying I owe them 100's of pounds for DC fees etc.
As for phone calls there's loads of advice relevant to ANY debt collector calls and how to stop them, if you simply Google 'Roxburghe phone calls'. The person on the phone won't have been APCOA themselves, it will almost certainly have been a sad debt collector pen pusher hoping you are daft enough to pay because they tell you to! So follow what you find in the search results on Google as I suggested you read (yes I know your debt collector may not be Roxburghe).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
